SEATTLE, WA, October 03, 2005 - LexisNexis Applied Discovery, a leading provider of electronic discovery services to the nation’s top law firms and corporations, today announced an expansion of the consulting services offered to its corporate clients. These services are used by corporations as a preventative measure to enhance litigation preparedness and help prevent costly e-discovery disputes. The consulting services program complements the award-winning Applied Discovery Online Review Application that serves as a repository and review interface for documents during the discovery phase of litigation or regulatory review.

“This latest expansion of our corporate consulting services represents the culmination of more than six years of work with some of the nation’s largest corporations,” said Michele Vivona, chief operating officer of Applied Discovery. ”Since 1999, Applied Discovery has worked with corporate executives and corporate legal staff to identify the earliest stages where potential e-discovery problems and disputes can be pinpointed and then avoided. The complete suite of consulting services now offered by Applied Discovery is based on direct feedback from corporate clients as they helped us define the areas where advance outside assistance can be the most valuable.”

The consulting services offered by Applied Discovery cover all phases of corporate e-discovery needs, and include:

Litigation Preparedness Consulting – Applied Discovery partners with companies to identify areas where the client may not be fully prepared for handling e-discovery issues when litigation or another legal document request arises. Key services offered in this area include document retention planning, auditing the effectiveness and legal defensibility of existing document retention plans, and auditing the company’s “litigation hold” policies and procedures. Each of these services is designed to aid the client in examining its internal processes to ensure that all are compliant with current legal standards, and to make certain that policies in place are actually being followed.

Data Collection Consulting and Data Collection Services – The data collection experts at Applied Discovery assist companies in designing data collection strategies so electronic documents can be harvested quickly and efficiently when the need arises. Reviewing trouble spots or areas where spoliation claims could arise, data collection consultants help create a protocol that can then be triggered when litigation is pending or imminent. Applied Discovery also offers data collection services to identify, search and gather necessary data from relevant company systems and users.

E-Discovery Strategy Consulting – Many companies are unprepared for managing a large document review project when electronic data is involved. Applied Discovery assists clients by designing and helping to implement a cost-effective, efficient protocol for electronic document review. The consultants are able to assist in preventative training situations, or when a case is pending or anticipated.

“As courts place more and more emphasis on corporate responsibility for effective electronic recordkeeping, it is critical for business executives to address these issues in advance of any particular litigation,” said Scott Nagel, vice president of Client Services at Applied Discovery. “The cost and effort of this kind of preventative work is minimal when compared to the costs expended without the advance groundwork, and our clients have the peace of mind in knowing that they will not be caught unprepared.”
