New narrative the most current exposition of Ohio ethics law, organized under the ABA’s Model Rules format

DAYTON, OH, November 03, 2005 - In anticipation of the Ohio Supreme Court’s likely adoption of an Ohio version of the American Bar Association’s (ABA) Model Rules of Professional Conduct, LexisNexis U.S. announces the availability of the Ohio Legal Ethics Narrative. This narrative is authored by Marc Swartzbaugh, a retired partner at Jones Day in Cleveland and Professor Arthur Greenbaum of The Ohio State University Moritz College of Law.

The Ohio Legal Ethics Narrative is the most current exposition of Ohio ethics law available. Significant portions of the narrative were adapted from an ethics treatise by Professor Greenbaum, a renowned Ohio ethics expert.

"Organized under the ABA Model Rules format, the Ohio Legal Ethics Narrative is an ideal guide for Ohio attorneys who are considering how existing Ohio ethics law fits under the Model Rules," said Swartzbaugh. "By following the arrangement of the Model Rules, the narrative greatly assists Ohio lawyers in finding analogous Code provisions, court decisions and bar association opinions under the pertinent Model Rule provision."

In March 2003, Chief Justice Thomas Moyer appointed a task force to review and recommend improvements to Ohio’s current ethics rules. The task force was asked to consider whether Ohio should move away from the Ohio Code of Professional Responsibility and join the overwhelming number of states that have adopted some version of the ABA’s Model Rules. A proposed Ohio version of the Model Rules is currently under consideration with the likelihood that some form of the Model Rules will be adopted in Ohio in 2006.

The Ohio Legal Ethics Narrative contains an extensive treatment of conflicts of interest. The narrative compares the conflicts provisions of the Ohio language of Canon 5 with various Disciplinary Rules and Ethical Considerations, including references to Ohio case law, Professor Greenbaum’s ethics treatise, and the Restatement (Third) of the Law Governing Lawyers.
