Press Room LexisNexis® Applied Discovery Conducts First Annual Online Litigation Support Manager Survey Survey addresses selecting and evaluating electronic discovery service providers, e-discovery experience, education trends January 7, 2004, Seattle, WA — As electronic discovery continues to grow and garner more attention in the legal industry, the vast majority of litigation support managers and other non-attorney litigation professionals surveyed have indicated that they are looking for a proven, reliable e-discovery service provider that offers quality products and services at a fair price. LexisNexis® Applied Discovery, a leading provider of electronic discovery services to the nation's top law firms and corporations, conducted this survey—The First Annual Online Litigation Support Manager Survey. The survey was administered in Sept. and Oct. 2003 with professionals in law firms and corporations across the country. Hundreds of organizations were invited to participate—of those responding, nearly 40 percent were concentrated in AmLaw 200 law firms. The survey addressed three key topics:
For selecting and evaluating an e-discovery service provider, the survey results indicate the number one factor considered is "overall value" of the provider's offering (31 percent), with "references and reputation" and "functionality of the review tool" following a close second (28 percent). The survey also indicates 66 percent of respondents believe the most important function of the e-discovery service is the core ability to search full text and meta data of electronic documents. Once the electronic discovery project is complete, the service provider is most frequently judged by whether case deadlines were met, with 40 percent of respondents indicating this is the number one factor for measuring success. Thirty-two percent reported that success is measured by reviewing actual costs versus estimated costs. An impressive 77 percent of respondents said they had experience using an online review application in e-discovery, with most having experience in one to five cases. E-discovery experience also has translated to the formation of specialized practice groups or committees in 31 percent of the respondents' firms and corporations. In the investigation of e-discovery education trends, 39 percent of respondents said they rely primarily on peer groups for electronic discovery education, with 31 percent turning first to legal journals or magazines. Forty-two percent of respondents felt that a growing acceptance of e-discovery by legal professionals was the most significant industry development in the past year. "As we plan for 2004, we'll take the lessons learned from the 2003 survey and put them to work," said Llewellyn. "The results of this survey will help guide us as we develop our products and services, and tailor our outreach to the legal community as part of our commitment to client satisfaction."
