Automatic Stay Not Violated

KNOXVILLE, Tenn. — A Tennessee federal judge on Feb. 5 affirmed a bankruptcy court’s ruling that a creditor did not violate the automatic stay by depositing a check paid to it before the petition was filed because there was not an improper retention of property belonging to the bankruptcy estate (Angela C. Davison v. Fred Kanipe, et al., No. 08-129, Chapter 7, E.D. Tenn.; 2009 U.S. Dist. LEXIS 8571).
