Florida Court Refuses To Dismiss Terminated Distributor's Antitrust Claims

WEST PALM BEACH, Fla. - A former marine paint distributor sufficiently alleged that two competing distributors unlawfully conspired to induce the paint manufacturer to refuse to deal with the former distributor and that the manufacturer agreed to set a minimum resale price to help the competing distributors increase the average retail price of its paint, a Florida appeals court ruled Dec. 14 (MYD Marine Distributor, Inc., et al. v. International Paint Ltd., et al., No. 4D10-2833, Fla. App., 4th Dist.; 2011 Fla. App. LEXIS 19927).
