Hospital Merger Is Immune From Antitrust Scrutiny, 11th Circuit Holds

ATLANTA - The 11th Circuit U.S. Court of Appeals ruled Dec. 9 that although a merger between two hospitals would substantially lessen competition or tend to create a monopoly, the state-action doctrine immunized the conduct from a challenge by the Federal Trade Commission (Federal Trade Commission, et al. v.
