Netflix Prevails In Antitrust Dispute Over Wal-Mart Online DVD Rental Agreement

OAKLAND, Calif. - A class made up of online DVD renters has not met its burden to demonstrate that a promotion agreement between Wal-Mart Stores Inc. and Netflix Inc. "constitute[d] a naked restraint on competition in the form of an express 'quid pro quo' agreement to allocate the market for online DVD rentals and sales," a California federal judge ruled Nov. 22, granting summary judgment to Netflix on antitrust claims against it (In re: Online DVD Rental Antitrust Litigation, 4:09-md-2029, N.D. Calif.; 2011 U.S. Dist. LEXIS 134836; See September 2011).
