Federal Judge Won't Exclude Testimony Of Witness Who Fabricated Evidence

CHICAGO - Purchasers of automobile aftermarket filters may rely on a witness's testimony during discovery related to their claims that manufacturers of the filters engaged in a conspiracy to fix the prices for the filters in violation of Section 1 of the Sherman Act, a federal judge in Illinois ruled Jan.20 in denying the manufacturers' motion to exclude (In re: Aftermath Antitrust Litigation, MDL No. 1957, Master Docket No. 08 C 4883, N.D. Ill.; 2012 U.S. Dist. LEXIS 6928; See November 2009).
