Hospital Defeats Motion To Dismiss Its Conspiracy Claim, N.J. Federal Judge Rules

CAMDEN, N.J. - A hospital in New Jersey plausibly alleged that other hospitals conspired to exclude it from the market for cardiac procedures but failed to plausibly allege that the other hospitals conspired to monopolize the market for emergency cardiac procedures, a federal judge in New Jersey ruled Dec. 30 (Deborah Heart and Lung Center v. Penn Presbyterian Medical Center, et al., No. 11-1290, D. N.J.; 2011 U.S. Dist. LEXIS 149664).
