9th Circuit Upholds Denial Of Class Certification In Countrywide Disclosure Suit

SAN FRANCISCO - The Ninth Circuit U.S. Court of Appeals on Jan. 20 affirmed a California federal judge's decision to deny certification of a proposed class alleging that Countrywide Home Loans Inc. failed to inform borrowers about changes to interest rates on their loans prior to closing but allowed the plaintiffs to engage in discovery as to whether the lender kept logs of calls in which initial disclosures were made orally (Randall Buckley, et al. v. Countrywide Home Loans Inc., No. 10-56180, 9th Cir.; 2012 U.S. App. LEXIS 1235; See May 2010, Page 4).
