SAN FRANCISCO - A federal judge in California on Jan. 17 granted a consumer's motion to strike 15 affirmative defenses as part of a law firm and one of its attorney's answer to the consumer's complaint, ruling that, under the heightened "plausibility" pleading standard, the defendants have failed to provide the consumer with adequate notice of the facts underlying the defense (John Henry Dion v. Fulton Friedman & Gullace LLP, et al., No. 11-2727-, N.D. Calif.; 2012 U.S. Dist. LEXIS 5116).
