- The Delaware Supreme Court in
late August held that shareholders of Bank of America who were not shareholders
before its acquisition of Merrill Lynch, still have standing to file a double
derivative lawsuit seeking to recover Merrill's pre-merger losses.
- Meanwhile, a judge on August 27
dismissed claims that Bank of America and its board of directors breached their
fiduciary duties under the Employee Retirement Income Security Act, by
permitting the investment of the company's retirement plan assets in company
stock at the same time it acquired Countrywide Financial and Merrill Lynch.
- A class action lawsuit was
filed Aug. 31 in Nevada federal court challenging the federal health care
legislation signed into law by President Barack Obama in March.
