Panel Affirms Business Income Loss Award, Bad Faith Damages Against Insurer In Katrina Claim

GRETNA, La. - A Louisiana appeals panel on Feb. 8 affirmed a lower court's judgment that a bakery insured sustained a business income loss exclusively as a result of a covered loss, finding that a jury did not err in concluding that an insurance policy's anticoncurrent causation (ACC) clause was inapplicable and in awarding the insured $83,247 for business income loss and $50,000 for bad faith damages and penalties (La Louisiane Bakery Company v.
