Judge Won't Dismiss Fair Debt Collect Practices Act Claim Against Debt Collector
TAMPA, Fla. - Dismissal of a Fair Debt Collection Practices Act (FDCPA) claim against a debt collector is not proper, a federal judge in Florida ruled Jan. 17, because a consumer has provided sufficient evidence to show that the defendant is a debt collector under the FDCPA (Lory Jean Pyle v. Erik Del'Etoile, et al., No. 12-2715, M.D. Fla.; 2013 U.S. Dist. LEXIS 7253).
