Magistrate Judge Finds Inadvertent Disclosure Did Not Waive Privilege

KANSAS CITY, Kan. - A federal magistrate judge in Kansas on Jan. 3 held that the inadvertent disclosure of an email between a company's former chief financial officer and an outside attorney did not result in a waiver of privilege because a protective order entered in the case allowed the privilege to remain intact (Eric C. Rajala, as Bankruptcy Trustee for Ethanex Energy Inc. v. McGuire Woods LLP, No. 08-2638-CM-DJW, D. Kan.; 2013 U.S. Dist. LEXIS 1761).
