MISSOULA, Mont. - A commercial general liability insurer had a duty to defend its insured contractor against claims of construction defects resulting in moisture damage to a home, a Montana federal judge ruled Feb. 11, granting partial summary judgment to homeowners assigned the insured's rights against its insurer (Robert Lukes and Shannon Lukes v.
