This Emerging Issue Analysis from the American Bar Association looks at gas quality and interchangeability issues. It specifically examines the following three matters before the Federal Energy Regulatory Commission:
1. Transcontinental Gas Pipe Line Company, LLC (Docket No. CP09-88-000)
2. Southern LNG, Inc. (Docket No. RP10-304-000)
3. Texas Eastern Transmission, LP. (Docket No. RP10-30-000)
This report is excerpted from the Spring 2010 Report of the Renewable Energy Committee of the American Bar Association's Section of Public Utility, Communications and Transportation Law. The Section of Public Utility, Communications and Transportation Law brings together members of the bar interested in the rapidly changing legal environment in the communications, cable TV, internet, electricity, gas, oil pipelines, aviation, motor carriers, railroads, and water industries. The third oldest Section in the ABA, the Section was established in 1917 when public interest demanded regulation of these fields. The Section currently has approximately 3,900 members, plus over 3,000 law students.
The Committee on Gas addresses natural gas issues on both the federal and the state levels. Annual reports are prepared summarizing current regulatory and judicial developments, seminars are sponsored, and special reports are published. Over the past decade, the natural gas industry has undergone major restructuring at the federal level with the pipelines, and for the past several years the states have began to deal with deregulation and unbundling of local distribution companies, which they regulate. The challenges associated with this evolution will continue into the foreseeable future, as the industry becomes far more market driven.
