Discovery Dispute Scheduled For February Hearing In Pennsylvania Stack Rain Case

PITTSBURGH - The plaintiffs in a putative class action coordinated for discovery in the U.S. District Court for the Western District of Pennsylvania filed a reply Jan. 20 in support of their objections to the recommendation of the discovery master to allow depositions of class members who are not named plaintiffs in the lawsuit alleging that smokestack emissions from a coal-fired power plant expose them to heavy metals and diminish their property values; a hearing on the dispute is scheduled for Feb. 14 (David Patrick, et al. v. FirstEnergy Generation Corp., et al., No. 08-1025 [consolidated], W.D. Pa.; See 11/1/11, Page 24).
