Pa. Federal Judge Dismisses Challenge To Health Care Act By Order Of 3rd Circuit

HARRISBURG, Pa. - Following a mandate by the Third Circuit U.S. Court of Appeals, a Pennsylvania federal judge on Dec. 4 vacated an order holding that the individual mandate contained in the Patient Protection and Affordable Care Act (PPACA) is unconstitutional under the commerce clause of the U.S. Constitution and dismissed the case for failure to state a valid claim for relief (Barbara Goudy-Bachman, et al. v. U.S. Department of Health and Human Services, No. 10-763, M.D. Pa.; See 10/31/12, Page 5).
