Judge Declines To Remand Denial Of Benefits Case, Finds Complete Diversity

HOUSTON - A Texas federal judge on Jan. 14 declined to remand a denial of health insurance benefits case to state court, saying that a subsidiary's principal place of business is not relevant for purposes of jurisdiction when it is an unincorporated division of a company (Brenda Coghlan v. Blue Cross Blue Shield of Texas, No. 12-2703, S.D. Texas; 2013 U.S. Dist. LEXIS 5111).
