Michigan Appeals Court Allows Medicaid False Drug Claims Suit To Proceed

GRAND RAPIDS, Mich. - The Third District Michigan Court of Appeals on Jan. 22 reversed a trial court ruling granting summary judgment to pharmacy defendants in a consolidated Medicaid false claims suit, saying the plaintiffs in a qui tam lawsuit and class action suits lack standing to bring such claims. The court further reversed summary judgment, saying the claims were pleaded with sufficient specificity showing the likelihood that the pharmacy defendants may have submitted false claims and that the pharmacy defendants may have committed violations of the state Medicaid statutes (State of Michigan, ex rel Marcia Gurganus, v.
