JCCP 4674 LAOSD Asbestos Litigation - IMPORTANT Reminders for Defense Counsel

Monday, November 14, 2011 marks the "Live Date" for the LAOSD Asbestos Litigation (JCCP No. 4674) on File & Serve for e-Service! Effective today, all documents to this litigation must be served electronically via File & Serve.

By now, you should have all received a "Getting Started" email that contained registration and training information. If you have not, don't panic! Simply contact our 24/7 Customer Support group at 1-888-529-7587 and they will help you get started.

As with many large implementations, there are likely to be various case data or other items to update once the cases are online. If you notice any cases with missing information or need help using File & Serve, please contact Customer Support and we will resolve those as quickly as possible.  If you are not able to find your case(s), then contact Customer Support. Some cases have not been loaded onto File & Serve yet and they will be able to update you on the status of setting up cases and availability.

IMPORTANT Procedural reminders:

    * All firms must still submit filings in paper to the court.  File & Serve will be used for e-service only.  E-filing is not permitted in this litigation. 

    * Per the Order (Order Authorizing e-Service), if you want to be removed from a Service List, a "Request to be Removed from a Service List" must be filed in paper and e-served in each case.  There is a specific filing type in the dropdowns for attaching that type of document.  If the Request is unopposed, then it is the responsibility of the Plaintiff's Firm in each case to update the Service List accordingly.

    * However, all firms can add or substitute the individual attorney(s) from your own offices using the Case/Party Management features of File & Serve. Instructions for making those types of updates are attached (Quick Guide).

    * All First Appearances filed on or after November 14, 2011 must be e-served in order for a firm to be added to a Service List on File & Serve. Here is a screenshot of how parties without attorney representation are listed in each case. To make your appearance, simply click the box next to each party you're making an appearance for. If your party is not listed, click the Add Party/ Attorney button. After submitting your transaction, the case will be updated to reflect your name and firm with the party. If you need to add more than one counsel from your office, you can add those later via Case & Party Management.

    * Per the Order, only documents issued from the Court should be posted to the master case (listed on File & Serve as "FOR JUDICIAL USE ONLY In re: LAOSD Asbestos Litigation JCCP 4674"). Firms should not upload documents to that case. Firms must upload documents to the individual cases only.
