Kanawha, Ohio & Raleigh County July 2011 Newsletter

This newsletter contains important information for the Mingo County Coal Slurry litigation, the Float-Sink litigation and the Asbestos litigation. Please scroll down to ensure you view all items.

OHIO COUNTY

 I. Firms Are Not Titling Their Exhibits Properly
A number of motions have been e-filed in the Mingo County Coal Slurry Litigation without the exhibits themselves being properly marked.  This creates confusion for the Court.  It is imperative that each exhibit have a cover page that identifies the exhibit, such as "Exhibit A" or "Exhibit 1." If you are uploading multiple exhibits in one document, be sure to "separate" your exhibits with a cover sheet so it is clear where the next exhibit begins. The court may reject your document if this is not uploaded correctly.

II. New Document Type Available Called "Unredacted Document for Serve Only Private"
File & Serve recently added a new document type to the drop down menu to assist firms with e-filing their confidential serve only private documents. Please be sure to select as the document type "Unredacted Document for Serve Only Private" when e-serving counsel with documents containing sensitive or private information.
Remember that when you submit this type of document, you must also select "Serve Only - Private" on the Review & Submit tab. This ensures that only the parties and firms you serve have the ability to "see" the transaction and documents.

RALEIGH COUNTY

I. Remember to Include the Case Number in the Document Title Field on File & Serve or your Transaction May be Rejected
The Raleigh County Court has indicated that many firms are failing to include the case number in the document title field when submitting their transactions. This information is required pursuant to the May 16, 2011 Case Management Order, paragraph 10(e). If you do not include the case
number(s), the court will reject your transaction and you will need to resubmit your documents.

 KANAWHA COUNTY

I. February 2012 Trial Group Designation
The court designated the cases belonging to February 2012 Trial Group via transaction no. 37744514. Remember to create your own trial group for the cases that your firm is actually involved in. You will then be able to submit multi-case transactions for those cases.


II. Change to October 2011 Trial Group
The court has removed the Griffith case (Phillip Eugene Griffith 10-C-203 MSH) from the October 2011 Trial Group and has included it in the February 2012 Trial Group. Please be sure to update your own firm's case groups with this information.

 I. E-service is More Secure Than Email
