Follow up to CO System Updates and New Features - File & Serve Complimentary Webinars Oct. 31-Nov. 2

The following is a Q&A from the trainings conducted Oct 31 - Nov 2. 

Q.  I was not able to attend the training. How do I learn about the updates?

A. You can watch/listen to a pre-recorded training session. To access the training, go to the File & Serve homepage and click the Resource Center link. Go to Education and Training. Then from the View Pre-Recorded Mini-Class drop down select CO System October 2011 Updates.

 

Q.  On LexisNexis File & Serve, can I look at documents and the docket for a case that was filed 7 years ago file and both parties were pro se?

A.  Pro Se parties are not allowed to use the File & Serve system, and the courts were not uploading documents in cases that were filed pro se.  Since File & Serve is a mirror of the court’s docket, the docket entries would be viewable, but there would be no documents available for viewing. 

 

Q.  In the above scenario, would I have to pay to search for the docket and pay to view the documents if they were available on File & Serve?

A.  Yes to both because you were not served via File & Serve in the case. 

 

Q.  What does it cost to search for a case in which I am NOT involved?

A.  $10 plus tax to search for the case, $6 plus tax per document

 

Q.  Why am I not being served/notified of Minute Orders from the court?

A.  Minute Orders are usually just typed entries into the courts case management system.  No document is produced. 

 

Q.  Can Alerts be used in Federal Court?

A.  LexisNexis File & Serve is only at the State level for Colorado.  LexisNexis CourtLink can be used at the Federal level.  Go to https://litigator.lexisnexis.com/Courtlink  for more information.

 

Q.  What is an “authorizer” on a filing?

A.  The authorizer is the attorney whose name is selected to authorize the filing on the Review and Submit tab.  It should be the same as the attorney that signed the document.

 

Q.  My LexisNexis File & Serve Inbox always indicates that I have unread messages, but when I open up the Inbox, nothing is displayed.

A.  Call our 24/7 helpdesk at 1-888-529-7587; however, the Inbox is filtered to show only the last 7 days.  If you open the Inbox, select “All” as the filter, you will probably find that there were unread notifications from prior to 7 days ago. 

 

Q.  Is the Transaction Report “real time”?

A.  Yes.  The Transaction Report will update within seconds of activity happening.

 


Q. What is the difference between the document access options Suppressed vs. Sealed, electronic?

A. If you have a document that contains sensitive information, but should be available to all active case participants (current and future) select suppressed. If your sensitive document should only be available for select parties use Sealed, electronic and only file/serve those parties. Please note the security status of a document is always at the court’s final determination. For more details, see the definition listed next to your selected access type when e-filing.

 

Q. What do I do when I need to access a sealed document that I should have access to?

A, Contact the court and request that they change the security status from sealed to suppressed. If the court determines the document must remain sealed, then you will need to obtain a copy from the court or the original filer. Please note Elizabeth Machado may no longer email documents.

 

Q. Can Colorado Firms use Message Board? I thought it was only for other e-serve projects.

A. Yes! Users can now active Message Boards by using the Activate a Message Board link.

 

Q. If another party activates message board in one of my cases, how will I know?

A. When any party activates a message board for a particular case, all the attorneys of record will receive a courtesy email notification.

 

Q.  What are the charges for participating in a Message Board?

A. You can view the messages sent to you at no charge. However, if you would like to respond you will incur a $5.00 charge per month per Message Board.

 

Q.  Can I move a document from one Custom Document List to another?

A.  No.

 

Q. What kind of documents can I upload using the new Document Upload feature?

A. Any and all documents that are related to your case that do not need to be filed or served.

 

Q. Who else has access to the documents I upload?

A. Members of your firm ONLY.

 

Q. If I use the Document Upload feature and then withdraw from the case,

will I still be able to access the document(s) I uploaded?

A. Yes.
