Are you interested in getting your cases in Sonoma, California set up for e-service? The Sonoma County Superior Court, working in conjunction with the Bench Bar Section of the Sonoma County Bar Association (SCBA), now offers voluntary e-service on LexisNexis® File & Serve!

If paper filing your documents is becoming expensive and time consuming, the SCBA website recommends e-service because it “cuts the time and expenses associated with pleadings and discovery, including postage, courier fees, printing costs, and stuffing envelopes by using a secure, password-protected Web site to disseminate documents." Law firms that are interested in implementing e-service in their Sonoma County cases can visit the SCBA’s Website to read more about this joint initiative between the Bench and Bar.

San Fran Court Expands E-Filing To Complex Litigation Cases

The San Francisco Superior Court has selected LexisNexis File & Serve as the e-filing and e-service provider for its complex litigation cases. E-filing and e-service is mandatory and begins on October 15, 2012. If your firm is involved in one or more complex litigation cases, please review the information packet attached below for details about registration and training.

How To Pay Court Reporter Fees in San Francisco Asbestos Cases

The San Francisco Superior Court's eFile Unit has implemented a new process for paying court reporter fees:

• For civil hearings lasting less than one hour, the moving party must pay a $30 fee when the court provides a court reporter, pursuant to Government Code § 68086(a)(1)(A).

• Currently in the asbestos cases, the court reporter fee only applies to hearings in Dept 514, such as a petition for minor's compromise or a disbursement of funds.

• To pay the court reporter fee, the firm representing the moving party must submit a cover letter or notice in the same e-filing transaction as the moving papers. The cover letter/notice should specify the case name, case number and name of the party that is paying the fee. The Document Type of "Notice of Payment for Court Reporter Fee" must be selected for the cover letter/notice. When the eFile Unit accepts the cover letter/notice, the $30 fee will be assessed on the filing firm through LexisNexis File & Serve. If the cover letter/notice is not submitted with the moving papers, the entire e-filing transaction (including the moving papers) will be rejected.

Saving Trees One Page at a Time

Colorado Springs, CO- In late June we watched, mesmerized and dumbfounded as the unthinkable, devastating, and sublime Waldo Canyon fire came barreling over the mountains and into Colorado Springs' neighborhoods. Tens of thousands of acres were ablaze across Colorado and in neighboring states and communities prepared for the worst as some were given only moments to pack their most precious possessions before being evacuated from their homes...many of these people not realizing that it would be the last time they would see houses instead of charred rubble.

Horrified, neighboring communities could only watch helplessly as emergency workers raced to save lives and structures and as homes and businesses were reduced to ruins. Although the fire and its path of destruction took its toll both physically and emotionally on Colorado Springs residents, the strength shown by the community and real-life heroes that emerged from the ashes was inspiring and reminded us of the power of the human will.

Now that the fire has been contained and as the community begins to rebuild itself, it is hard to imagine how long it will take to restore the ecosystem to its former grandeur and beauty. The scars of burnt acreage left by the Hayman Fire that torched areas near the same region of the Rocky Mountains a decade prior to the event can still be seen today. Although it may seem hopeless to many, Colorado residents are willing to make the commitments necessary to rebuild our homes, forests and ecosystem - even though it may take years or decades to do so.

While thinking about the devastation of the forest by the fire, and reflecting about rebuilding and restoration, I began to also think of preservation. Coincidentally, I was reminded of a simple fact that a colleague once shared with me: a 2008 survey conducted by Arnold & Porter reported that a single attorney uses an average of between 20,000-100,000 pages of paper per year. This is equal to approximately ½ of a tree and 2 ½ trees per attorney per year in 2008.

As it takes a community and the work of many people to defend and restore our environments and ecosystems during and after natural disasters like the Waldo Canyon fire, so it also takes communities to find ways to preserve those resources and to promote sustainability. I am happy to report that whether they know it or not, the many loyal customers of LexisNexis® File & Serve, along with any individual or organization that is taking steps to create "paperless" environments, are part of that community that helps preserve our resources.

Between January 2008 and May 2012, by choosing to use File & Serve as opposed to traditional paper service, our customers have saved over 220,596 trees! That is equal to over 315 acres of trees or 612,769 feet of paper! Check out the table below for the breakdown.

Case Update: State of Indiana et al vs. International Business Machines Corp

On Wednesday, July 18, Marion County Superior Judge Dreyer issued his final order in the State of Indiana vs. IBM case. In January, the State was ordered to pay $40 million in subcontractor assignment fees. On July 18, an additional $12 million was awarded to IBM for early termination closeout payments and equipment- for a total of more than $52 million including associated fees.

The order is available on LexisNexis® File & Serve (Transaction Identification Number 45413868). Additionally, all documents filed on and after 2/14/2012 are currently available on the File & Serve system.

Sonoma County, CA Offers Voluntary E-service!

We are pleased to announce that the Sonoma County Superior Court, working in conjunction with the Bench Bar Section of the Sonoma County Bar Association, now offers voluntary e-service on LexisNexis® File & Serve! LNFS Welcomes the DC PERB to Online Service!!!

The District of Columbia’s Public Employee Relations Board (PERB) is an independent agency that resolves labor management disputes between agencies of the District government and labor organizations that represent agency employees. The Board accepts pleadings under Bargaining Unit Representation and Impasse resolution. (DC PERB Website).

Although DC PERB is not a Court, but “…an impartial, quasi-judicial, independent agency…,” on March 26, 2012, the Board officially announced that it had elected to use LexisNexis® File & Serve as its electronic filing solution (Click here to view the announcement). DC PERB is the first agency of its type to join Courts, Arbitration Groups, and Mass Torts litigation cases that have chosen to use File & Serve.

The first day of live E-filing, or “Live” date, for the organization was on April 9, 2012. File & Serve representatives where there to celebrate the day with DC PERB and provide support. When asked how File & Serve would benefit DC PERB, Attorney Advisor, David Washington remarked that “PERB is now leading the way with LexisNexis File & Serve for improved service for District of Columbia agencies in managing new filings, organizing caseloads and handling litigation.”
