NEW! IN Marion County Mass Tort Reference Manual
Case & Party Management and Multi-Case Filing. Recently, we have received some questions about Marion County IN Mass Tort including: "How do I withdraw or substitute an attorney?", "How do I do a Multi-Case Filing?", and, "How do I add my attorney when I am filing an appearance?" The answers to these questions and others can be found using various resources on the File & ServeXpress Resource Center and the Court's website.

While there are several resources available to you to answer these types of questions, none of this information has been compiled so you can easily access all information in an indexed manual. Accordingly, we are pleased to inform you that we have created an updated IN Marion County Reference Manual to provide our clients with a comprehensive resource!

The manual includes the answers to the questions above, registration information, regional contact information, hyperlinks to online resources, and much, much more! Accessing MC 95-000 Archived Vol 1
Some firms have been inadvertently e-filing and or e-serving documents in the Archived case in error. In order to eliminate this issue, the parties have been removed from the service list. However, parties DO still have free access to the archived case and documents- you will just need to access it in a different way than you used to.

In order to access the archived case at no charge, parties should use the Case History search option from the Search tab on File & ServeXpress. Below are the step-by-step instructions:

Case History Search

1. Use the drop down menus to choose Indiana as the Jurisdiction.
2. Use the drop down menus to choose Indiana Marion County Court as the Court.
3. Click on the radio button for All Transactions.
4. Type MC in the Case Number type field.
5. Click the View button.

If users select the Mass Tort case class and are on at least one case in the litigation, there is no charge for their search. So, users can also access the MC via the other Search options by using the following criteria:

Accessing Real-Time Billing Information on File & ServeXpress
The Billing Information link gives users the ability to view past invoices, to obtain reports of various billing activity, and to request electronic copies of invoices via email.
The instructions for using this tool can be found by clicking the Billing Information hyperlink from the Toolbox in the File & ServeXpress homepage:

Mountain State University Litigation Active on File & ServeXpress
We are pleased to announce that the Mountain State University Litigation, Kanawha County Civil Action Number 12-C-9000, was added to the File & ServeXpress system on February 1st, 2013. For your reference, the Case Management Order can be found on the system using Transaction Identification Number 49340519.

There has been some confusion about previously-filed pleadings in this litigation. For clarification on this topic and other rules and orders, please remember to read both Trial Court Rule 15 and the Case Management Order (TID 49340519). Several zero fee document types have been added to the system for these documents:

Notices of Depositions for Exigent Plaintiffs
Many times Notices of Depositions for exigent plaintiffs are served prior to all defendants being served with a complaint. When that happens, some defendants may miss the deposition of a very sick plaintiff. Plaintiff firms are aware that some of the defendants have not been notified of the date/time of the depositions because they have not yet been served with the complaint.

In order to ensure that your firm is notified of these pleadings, we suggest setting up Alerts to be notified of Complaints, Notice of Deposition, Notice of Deposition of Exigent Plaintiff, and Notice of Cancellation in your specific litigations to be sure that these important documents are not missed.

Confidential Documents and Documents Containing Personal Data Identifiers
The Court has asked us to remind firms that Personal Data Identifiers should not be included in e-filed pleadings, as anything filed with the Court can be accessed publicly.

Any document that contains a Social Security Number or a Date Of Birth needs to be redacted. The last 4 digits of the SSN can be included if it is absolutely necessary to file this information in the body of the pleadings.

It is not the responsibility of the clerk doing clerk review to scan these documents for this personal information. If personal data identifiers are included in your pleadings, and the Court notices it, they will reject your documents.

Additionally, the Court would like firms to be familiar with the procedure for submitting confidential documents and documents containing personal data idenitfiers. The procedure can be access by clicking here.

*In Regard to Medical Records in Asbestos Litigation: medical records should be provided to the medical records depository as noted in the Case Management Order entered on Janaury 12, 2012 with regard to Asbestos Litigation. Counsel should then file Notice electronically with the Court to let parties know that certain medical records are being uploaded to the depository.

Executing the Judge's Electronic Signature on Proposed Orders
The Court has recently had a problem with firms executing the Judges signature electronically on proposed orders. The judge or his staff, by authorization by judge, should be the only person(s) electronically signing any order from the court. All proposed orders must leave the signature line for the Judge blank. FILERS SHOULD NOT APPLY A JUDGE'S E-SIGNATURE TO ANY DOCUMENT.

Best Practices: Suggested Number of Documents in a Transaction
With the most recent filing deadlines in the asbestos litigation, the Court has noticed that firms were filing as many as 30+ documents in one transaction. This creates clerk review issues including system slowness which makes clerk review difficult. Please be considerate and follow the best practice suggestions of limiting your document size to 5 MB's or less and also limit your transactions to 30 MB's or less.

IL Supreme Court NEW e-Filing Recommendations
On October 24, 2012, Chief Justice Thomas L. Kilbride announced new statewide standards for e-Filing in Illinois trial courts. These recommendations simplify the e-Filing process in Madison County. For more information on the standards, please visit the Court's Website.

In accordance with the announcement of the new standards, we want to remind you of the following great benefits of using File & ServeXpress for all of your e-Service needs:

• You upload the document to be served ONCE, and the other parties are served,
• We provide a single service list and 24 hour server availability to access your documents,

Asbestos Cases: Important Information About Titling Documents
The topic of putting party's names in the document titles of your asbestos cases has come up in some firms recently. So, we wanted be sure that you were aware that it is extremely helpful and important to include the party's name in the document title when submitting filings in E-serve Only Master Cases ("MC"). Doing this will enable all firms to search for documents related to their particular party(s) more quickly and efficiently.

McLean County: New e-Serve Litigations
(1) We are pleased to announce that effective Friday, November 30, 2012, the Sunderland v Pneumo Abex et al (12L 107) Asbestos Case in IL McLean County Circuit Court began using File & ServeXpress for electronic service of documents pursuant to the Order implementing electronic service.

As Section II of the Order references, firms will only be using File & ServeXpress for electronic service of documents between counsel. Firms will continue to paper file their pleadings directly with the court.

(2) We are also pleased to announce that effective Thursday, January 3, 2013, the Whittington, Rodney et al vs Honeywell et al (12 L 101) Asbestos Case in IL McLean County Circuit Court began using File & ServeXpress for electronic service of documents pursuant to the Order implementing electronic service.

As Section II of the Order references, firms will only be using File & ServeXpress for electronic service of documents between counsel. Firms will continue to paper file their pleadings directly with the court.

It is important that all participating attorneys are registered members of File & ServeXpress so they will not miss service of important documents in this case. If your firm does not have an existing account, or if you need to add new LexisNexis File & Serve users, please contact Customer Support at 888-529-7587 or email Robert Rodriguez @ rrodriguez@fileandservexpress.com.

DuPage County: New Document Type
For your convenience, a new document type was added in IL DuPage 18th Judicial Circuit Court. The "Appearance - Fees Previously Paid" document type can now be selected from the "Type" drop-down list on the "Documents" tab.

Reminder: All Madison County Civil Cases Over $50,000 and Arbitration Cases Are Available on File & ServeXpress
To activate your case electronically, plaintiff's counsel can simply e-file their complaint and enter the parties in the case. You will still "serve" the complaint the traditional way with a process server. Defense counsel can simply upload their pleading regardless of whether the case was initiated electronically.

Colorado Judicial Branch and File & ServeXpress partner on remaining rollout of new Integrated Colorado Courts E-filing System

DENVER – The Colorado Judicial Branch has reached an agreement with File & ServeXpress (formerly LexisNexis File & Serve) to provide e-filing services through June, 30, 2013, as the Branch continues to implement the Integrated Colorado Courts E-Filing System (ICCES) throughout Colorado’s judicial districts.

"By partnering with File & ServeXpress, we can ensure that each judicial district brings ICCES online in the most effective manner possible for everyone involved," said State Court Administrator Gerald Marroney. "With the rollouts of ICCES that began this past October, we learned how important it is for us to provide customized training and implementation for each judicial district. In order to accomplish this, we felt it necessary to continue to provide e-file services with some outside support."

ICCES is fully operational and is currently being used in the 14th Judicial District (Grand, Moffat and Routt counties), 17th Judicial District (Adams and Broomfield counties) and 20th Judicial District (Boulder County).

The remaining ICCES rollout schedule is as follows:

I. File & Serve Read Status & Transaction Status Report for Delaware Transactions

Have you ever wondered if and when opposing counsel opens served documents?

Do you need to know ALL the filing and delivery details about a transaction - all in one place?

If so, we encourage our users to try our Read Status Report and Transaction Status Report during the month of August at no charge!

What does the Read Status Report provide? It displays the date and time an e-served recipient has opened a served transaction. While this feature normally costs $2.00 per transaction, we are providing it at for the month of August, 2011. The Read Status report can be ordered during your filing or accessed any time after a document is e-served. NO COST

The Transaction Report is a comprehensive up-to-the-minute report outlining all the delivery details for a transaction. Firms are using this report for the following:

Sharing with clients as proof of filing, delivery and court review status;
Handy reference for important transactions to include at hearings or trials;
Includes official stamp from LexisNexis File & Serve;
Updates are in "real-time" so you can continually monitor for updates.

While the Transaction Report normally costs $10.00 per transaction, we are offering it at NO CHARGE for the month of August for Delaware transactions.

II. Delaware Court of Chancery Updates

Due to the retirement of Chancellor Chandler and new appointments in the Court of Chancery, some of the Delaware Court of Chancery case numbers have been changed. All open cases ending in -VCS have been changed to -CS to reflect the appointment of Chancellor Strine; and all open cases ending in -CC have been changed to -VCG to reflect the appointment of Vice Chancellor Glasscock.

III. Delaware Supreme Court Family Case Appeals

This is a reminder that in order to get added to the service list of a Delaware Supreme Court Family Appeal case, you must call the court and they will add you. This is due to the security level of the family law cases on File & Serve. The court has indicated that the best number to call is 302-739-4155.

V. Using the "My Attorneys" Feature From the Home Page of File & Serve

The My Attorneys feature provides easy access to yoru attorneys cases so that you can view the documents or begin filing and/or serving in the case.

Click My Attorneys to begin;
Use the drop down menu to view a listof your firm's attorneys;
Select an attorney name. Click Add User.

Once you have selected an attorneys name, you can use My Attorneys to retrieve the attorney's case list.

Click My Attorneys;
Click the +sign to see the list of cases for your attorney;
Click the case name to view the Case History Report (the list of dlcuments filed and/or served in the case); or
Click the F&S arrow to begin a filing and/or service transaction in the case.
