Federal Judge Dismisses Insurer's Action In Favor Of State Court Lawsuit

DOTHAN, Ala. - A federal judge in Alabama on April 25 dismissed an insurance company's coverage action regarding its duty to defend and indemnify in favor of the underlying state court lawsuit filed against the insureds because the insureds filed a third-party complaint against the insurer that involves the same coverage issues (The Cincinnati Specialty Underwriters Insurance Co. v.
