Maine High Court Vacates, Remands Judgment Against Insurer, Finds No Coverage

PORTLAND, Maine - A claimant cannot recover damages for negligent infliction of emotional distress independent of the intentional acts or the sexual misconduct excluded from coverage under a homeowners insurance policy, the Maine Supreme Court held May 10, vacating and remanding a lower court's ruling against the insurer (Jennifer [Colman] Jacobi v. MMG Insurance Company, No. Han-10-526, Maine Sup.; 2011 Me. LEXIS 57).
