Finding That 'Wear And Tear' Caused Computer Crash Negates Coverage, Judge Rules

BOISE, Idaho - An insurance policy's exclusion for "physical loss or physical damage caused by or resulting from . . . wear and tear" precluded any coverage for a computer billing firm's claimed damages from an eight-day loss of computer functions, an Idaho federal judge ruled Feb. 8, disposing of bad faith and breach of contract claims against the insurer (Daniel W. Crandall v. Hartford Casualty Insurance Co., et al., No. 1:10-cv-00127, D. Idaho; 2013 U.S. Dist. LEXIS 17653).
