HOUSTON - An insured failed to assert claims against an insurance agent for breach of contract, breach of fiduciary duty, unjust enrichment, negligence, breach of the Texas Insurance Code, breach of the duty of good faith and fair dealing and malice, a Texas federal judge held Feb. 11, dismissing the claims (The Landing Council of Co-Owners v.
