Postdoctoral Research Fellowship
The Quebec Research Centre of Private and Comparative Law (QRCPCL) intends to appoint a
Postdoctoral Research Fellow with effect from August 2011. The position is funded by a Research Team
Support Grant from the
Fonds québécois de recherche sur la société et la culture
(Quebec Fund for
Research on Culture and Society). The team is led by Professor Lionel Smith, director of the QRCPCL,
and composed of colleagues from McGill’s Faculty of Law and beyond. The position is for one year, with
the possibility of renewal for a second year.
ABOUT THE QUEBEC RESEARCH CENTRE OF PRIVATE AND COMPARATIVE LAW
Based at McGill University in Montreal (Quebec, Canada) the QRCPCL is the only research centre in
Canada devoted to research in fundamental private law. Quebec’s private law is civilian, but it evolves in
a North American environment that is otherwise largely grounded in the common law. Quebec’s private
law therefore provides a living model for the fruitful coexistence of two legal traditions, in which the
ongoing interaction of the common law and the civil law is combined with the interaction of French and
English in Quebec’s bilingual civil law.
The research agenda to which the position relates revolves around three axes:
1) McGill’s transsystemic approach to legal education, and its impact on our understanding of law;
2) the interactions between intellectual property law and private law, in Canada and beyond; and
3) trusts in Quebec civil law, and in civilian and mixed legal systems generally.
QUALIFICATIONS:
The applicant must hold a doctoral degree in law at the time of the appointment. The ideal candidate will
have a solid track record of research in private and comparative law, and will propose an interesting
research project that interacts with the goals of the QRCPCL and the research agenda mentioned above.
The successful candidate will pursue his or her own research project on a topic relating to one of the
QRCPCL’s axes of research. He or she will also assist in the activities of the QRCPCL, principally through
involvement in the organization of a conference on transsystemic and comparative legal thought, to be
held in the second quarter of 2012. He or she may also be invited to speak at the conference, and to take
a role in the editing of a volume of papers presented at or arising from the conference.
APPLICATION PROCEDURE:
The review of applications will begin on 31 March 2011 and continue until the position is filled. The
preferred starting date is August 2011. The position will pay C$40,000, and an office and computer will be

submit a covering letter, a curriculum vitae, a research proposal (maximum four pages), a transcript of
postgraduate studies, and one or more writing samples (from peer-reviewed publications if possible).
Applicants should also name three referees, who may subsequently be invited by the QRCPCL to send
letters of reference.

Stage postdoctoral
Le Centre de recherche en droit privé et comparé du Québec (CRDPCQ) accueillera un stagiaire
postdoctoral à partir d’août 2011. Le poste est financé grâce à une subvention de soutien aux équipes de
recherche du
Fonds québécois de recherche sur la société et la culture
. L’équipe est dirigée par le
directeur du CRDPCQ, le professeur Lionel Smith et regroupe des chercheurs issus de la Faculté de droit
de McGill et d’ailleurs. Il s’agit d’un poste d’un an susceptible d’être prolongé pour une deuxième année.
LE CENTRE DE RECHERCHE EN DROIT PRIVÉ ET COMPARÉ DU QUÉBEC
Établi à l’Université McGill situé à Montréal (Québec, Canada), le CRDPCQ est le seul centre de
recherche canadien voué à la recherche en droit privé fondamental. Le droit privé québécois est civiliste
mais il évolue dans un environnement nord-américain largement ancré dans la common law. Le droit
privé québécois offre donc le modèle vivant d’une féconde cohabitation entre deux traditions juridiques.
Aux interactions constantes entre le droit civil et la common law s’ajoutent celles entre le français et
l’anglais au sein d’un droit privé bilingue.
Le programme de recherche au sein duquel s’inscrit le poste est articulé autour de trois axes :
1) L’approche transsystémique de l’éducation juridique de McGill et ses impacts sur la
compréhension du droit;
2) Les interactions entre le droit de la propriété intellectuelle et le droit privé au Canada et ailleurs;
3) La fiducie en droit civil québécois et plus généralement dans les systèmes mixtes et civilistes.
QUALIFICATIONS REQUISES
La candidate ou le candidat doit être titulaire d’un doctorat en droit au moment d’entrer en poste.
Idéalement, il ou elle doit avoir à son actif un solide parcours de recherche en droit privé et comparé et
présenter un projet de recherche intéressant et interagissant avec le programme de recherche décrit plus
haut.
Le boursier ou la boursière postdoctoral(e) pourra mener ses propres recherches sur un sujet lié à l’un
des axes de recherche du CRDPCQ. Il ou elle contribuera aux activités du CRDPCQ, principalement en
participant à l’organisation d’un colloque sur la pensée juridique transsystémique et comparée qui se
tiendra au deuxième trimestre de 2012. Il ou elle pourrait aussi être invité à présenter une communication
lors du colloque et à participer à l’édition des actes du colloque.
PROCESSUS DE MISE EN CANDIDATURE
L’évaluation des dossiers de candidature débutera le 31 mars 2011 et se poursuivra jusqu’à ce que le
poste soit pourvu. Préférablement, le poste devrait être occupé à partir d’août 2011. Des émoluments de
40 000$C seront versés et le ou la stagiaire aura un bureau et un ordinateur à sa disposition. Le dossier

trois personnes susceptibles de fournir une lettre de recommandation au soutien de sa candidature.
