9th Circuit Finds Dispute Over Contribution For Reef Damage Is Not Arbitrable

HONOLULU - The Ninth Circuit U.S. Court of Appeals on July 26 affirmed a district court's ruling in a dispute over indemnity and contribution to a coral reef, finding that when applying federal arbitrability law, the case was not arbitrable (Cape Flattery Limited v. Titan Maritime LLC, a Crowley Company, DBA Titan Salvage, No. 09-15682, 9th Cir.; 2011 U.S. App. LEXIS 15360).
