6th Circuit Vacates, Says Government Lacks Standing To Sue Chapter 13 Trustees

CINCINNATI - A panel of the Sixth Circuit U.S. Court of Appeals on Jan. 30 reversed and remanded a district court ruling and held that the U.S. government, which sued a group of Chapter 13 trustees alleging that they violated the government's sovereign immunity, lacked standing to bring its claim because it sued the wrong party (United States of America v. Krispen S. Carroll, et al., No. 10-1400, 6th Cir.).
