Judge Dismisses Contract Claims In Suit Over Site Cleanup

BALTIMORE - A federal judge in Maryland on Jan. 26 dismissed breach of contract claims asserted by plaintiff companies against Sherwin-Williams Co. over the cleanup of contamination of a nine-acre tract of land the companies purchased because the purchase sale agreement (PSA) and applications to the Maryland Department of the Environment (MDE) to the Voluntary Cleanup Program (VCP) did not create a binding agreement that required Sherwin-Williams to remediate the land (Carroll Company, et al. v. Sherwin-Williams Company, No. WMN-11-1700, D. Md.).
