Judge: Lead Plaintiffs Failed To Plead Material Misrepresentation, Scienter

BURLINGTON, Vt. - Lead plaintiffs in a securities class action lawsuit have failed to plead that a company's chairman of the board of directors issued any material misrepresentations regarding the company's business and financial condition and failed to properly plead scienter with regard to any of the remaining defendants, a federal judge in Vermont ruled Jan. 27 (Jerzy Warchol, et al. v.
