D.C. Judge: HHS Can't Enforce Retroactive Medicare Payment Rule

WASHINGTON, D.C. - A federal judge in the U.S. District Court for the District of Columbia on Jan. 30 granted a motion for summary judgment for the Catholic Health Initiatives - Iowa Corp., doing business as Mercy Medical Center, saying the U.S. Department of Health and Human Services (HHS) must use an earlier interpretation of Medicare Part E - the "prospective payment system" for the statute - that includes dual-eligible hospital patient days in its calculation for "disproportionate share hospitals" (Catholic Health Initiatives - Iowa Corp., d/b/a Mercy Medical Center - Des Moines, v.
