Judge Denies Environmental Plaintiffs Access To Nontestifying Experts' Data

ST. CROIX, Virgin Islands - A federal judge on Feb. 1 ruled that the Virgin Islands' government and its commissioner of the Department of Planning and Natural Resources failed to show that exceptional circumstances existed to warrant the disclosure of data and photographs taken by two nontestifying experts for defendants in a Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) case (Commissioner of the Department of Planning and Natural Resources, et al. v. Century Aluminum Company, et al., No. 06-62, D. Virgin Islands).
