Coverage Suit Over Alleged Prescription Drug Scheme Will Stay In Federal Court
BOWLING GREEN, Ky. - A Kentucky federal judge on Feb. 13 found that relevant factors weigh in favor of the federal court's exercise of jurisdiction over a coverage dispute arising from allegations that an insured "substantially, illicitly, and tortiously benefitted financially" from West Virginia's prescription drug abuse problem (Cincinnati Insurance Co. v. Richie Enterprises LLC, No. 1:12-CV-00186-JHM-HBB, W.D. Ky.; 2013 U.S. Dist. LEXIS 19380).
