Revolution Eyewear, Inc. v. Aspex Eyewear, Inc., 2009 U.S. App. LEXIS 9415
District court did not err when it found that an eyewear company infringed U.S. Patent No. RE 37,545, which described a spectacle frame that supported an auxiliary frame, when it manufactured its own frames, and the evidence supported a jury's determination that an assignee was entitled to a royalty rate of 5% on frames the eyewear company sold.
