He was of counsel before the Supreme Court in two of its leading decisions on ERISA remedies and preemption, Massachusetts Mutual Life Ins. Co. v. Russell, and Pilot Life Ins. Co. v. Dedeaux, and is part of a team representing the petitioner before the Supreme Court in an ERISA preemption challenge to San Francisco's "pay-or-play" law, Golden Gate Restaurant Association v. City and County of San Francisco.



David S. Foster is a partner in the San Francisco office of Nixon Peabody LLP. Mr. Foster's practice is in the tax, employee benefits, and executive compensation areas. He served with the U.S. Treasury Department in Washington, D.C. from 1972 to 1977as the chief Treasury Department spokesperson for the pension legislation which became ERISA.
