Judge: Couple Presented No Facts Showing Disclosure Statements Were Insufficient

NEW YORK - A federal judge in New York on Dec. 14 awarded summary judgment to Emigrant Mortgage Co. after finding that a couple failed to present any evidence showing that disclosure statements provided to them during the refinancing of their home mortgage loan were deficient under the Truth in Lending Act (TILA), thereby warranting an extension of their right to rescind (Davi Schwartzbaum, et al. v. Emigrant Mortgage Company, No. 09 Civ. 3848, S.D. N.Y.; 2012 U.S. Dist. LEXIS 177492).Full story on lexis.com
