Delaware: New Workers' Compensation Rates Effective June 16, 2009

On June 16 the Delaware Secretary of Labor announced that the average weekly wage in Delaware for the calendar year 2008 was $916.00.  Based on this figure, the maximum weekly workers' compensation rate will be $610.67.  The minimum workers' compensation rate will be $203.55.   The rates in effect for the preceding year (6/3/08 to 6/15/09) were $605.15 (maximum) and $201.72 (minimum).  And as a reminder to all practitioners: if the claimant's average weekly wage is less than the minimum available rate, then the claimant's weekly TTD rate is the same as his average weekly wage.
