SPOTLIGHT ON . . . New LexisNexis®
PatentOptimizer™ Toolbar Simplifies and Fortifies Patent Drafting
and Litigation
Are the patents your IP attorneys prosecute tightly constructed?
What about the patents your attorneys are challenging or defending
in litigation?
New LexisNexis PatentOptimizer can help your IP attorneys create
stronger patent applications and analyze patents—with new product
functionality never available in the market before. Your IP
attorneys will be more confident that their patent prosecution and
patent litigation work is thorough, accurate and efficient.
Here’s how PatentOptimizer works:
This revolutionary new software application is designed specifically
so attorneys can use it as they draft and analyze patent
applications (for patent prosecution) and/or analyze granted patents
(for patent litigation).
Users who subscribe to PatentOptimizer find an additional toolbar
integrated into Microsoft® Word and into Internet Explorer, so they
can tap into the features while drafting or while analyzing
published applications and granted patents retrieved from the Web.
Closely aligned with www.lexis.com, the PatentOptimizer toolbar
allows users to link to full-text patents available through the
LexisNexis® services as well as to cases that have referenced key
terms in the patent in question.
Plus users can produce reports on key-term usage across claims and
descriptions. For example:

KNOWLEDGE EXCHANGE . . . Segment Searching in
Patents: Getting to the Heart of the Matter
By
Leanne Battle
Librarian Relations Consultant,
LexisNexis Librarian Relations Group
When I was a law firm librarian, a
new associate walked into my office and requested a copy of the
patent for the original telephone.
Sounded straightforward enough. So
I turned to the USPTO immediately. But there was no help there
because searching for patents issued prior to 1976 required a patent
number or current classification, neither of which I knew. I could
have saved myself some time by starting with the LexisNexis
services.
I realized there would be thousands
of telephone-related patents that referred to Alexander Graham Bell,
and since I did not remember the exact date of the invention (my
apologies to the history teachers out there), I needed to narrow my
search.
Fortunately the LexisNexis services
offer a wide variety of document segments for patent searching.
Beginning in 1836, utility patents can be searched through
LexisNexis using the Detailed Description segment (DETDESC)
and the Claims segment (CLAIMS), among others. That allowed
me to search patents based on how the invention is described and
what the inventor claims it can do.
My search—DETDESC(telephone)
AND graham bell—retrieved a mere 51 patents. Patent search
results are returned in reverse chronological order, so I simply
went to the last entry in the list and Voila!—Patent No.
186787, the telephone, complete with a PDF of the official patent.
So I got curious. What other handy
segments might there be for searching patents? Beginning in 1971,
utility, plant and design patents available through www.lexis.com
are truly full-text searchable and include drawings, equations
and chemical structures.
A quick look at the source’s online
description (Just click the “i” icon next to the menu title.)
revealed that I can search a variety of segments, including TITLE,
INVENTOR and ASSIGNEE (the entity that holds the
rights to the patent). I can also search segments useful in the
litigation process, such as LEGAL-REP, EXPIRATION-DATE
and LIT-REEX (notices of litigation or requests for
re-examination).
A few weeks later, my curiosity
about patent searching paid off. I was asked to create a list of
U.S. patents held by a number of our clients. Not just any patents,
though. I needed patents due to expire within the next two years
that had another law firm listed as the legal representative. This
was business we wanted to bring into the firm.
Of course, I could have constructed
a separate search for each client, but I’m too budget- and
time-conscious for that. I wanted a single search that would satisfy
all of the requirements.
Here’s my search: (All names have
been changed to “protect the innocent.”)
ENTER: ASSIGNEE(Cingular OR Motorola OR Nokia OR
Panasonic) AND expiration-date>2000 AND NOT LEGAL-REP(XYZ)
Ta-Da! Now for the follow-up. Service-oriented librarian that I am,
I offered to update this list on a monthly basis. I set up a monthly
ECLIPSE™ feature search under my own LexisNexis ID. (This is
significantly less expensive than manually running this search each
month.)
Each month, when the new results
arrived, I ran a quick FOCUS™ search on each client name (at no
additional charge), arranged the individual cite lists
alphabetically by client name and delivered them to the partner in
charge of the Patents group. She was overjoyed, and I scored major
points for the library!
You can do the same. And you have
several resources to help you. For additional information on
searching patent materials on the LexisNexis services, check out the
30-page Intellectual Property Research Guide available at
http://www.lexisnexis.com/literature/default.asp or contact
your LexisNexis Librarian Relations Consultant.
TAKE A TOUR . . . Tax Research Tasks Page
Brings Together the Best LexisNexis Offers
The names your tax practitioners
rely upon are here—CCH®, Tax Analysts, Inc., BNA®, EDGARPlus®,
Matthew Bender® and more. But the expertise that the LexisNexis® Tax
Research Tasks page offers is only part of its value.
Not only can you find premier
analysis and the most current primary coverage, but you can get the
most complex tax information with simple search forms and links. You
can complete many tasks in one step, without moving through menu
screens to select a resource. Just fill in the form’s blanks and
choose an option from a drop-down menu.
You’ll find the Tax Research Tasks
page under the RESEARCH TASKS tab at
www.lexis.com. Select
Tax from the list of Research Tasks pages.
Or you can select the Tax Research
Tasks page as your default tasks page, i.e., whenever you select the
RESEARCH TASKS tab, the Tax Research Tasks page will display
automatically. To set the default, click the Set as my default
Research Task Page link at the top of the Tax Research Tasks
page.
Here’s what you’ll find when you
turn to the Tax Research Tasks page:

A
Search Tax Sources
Search the source you need, or—more importantly—combine any or all
of the sources listed and search them simultaneously.
B Tax News and Legal
Developments
Click to read the most recent issue of the most respected analysis
in the tax marketplace. Then select New Search to research all past
issues. Or choose to go to any of the last 10 issues.
C Quick Tax Searches
Find lots of options here. Get an IRC section, Treasury regulation,
Federal Register document or current U.S. bill by cite. There’s cite
formatting help right there, too. Or retrieve tax cases by cite,

words or LexisNexis® Case Summaries findings.
D Get an IRS Ruling or
Release
When you know the cite, you can choose from more than 15 document
types—everything from CFR documents and General Counsel Memoranda to
Private Letter Rulings and Treasury Decisions. Just select, add the
citation in the pre-formatted box and click GO.
E Find IRC Annotations
Here’s a simple way to get to Code interpretation and subsequent
decisions. Just choose your IRC section and add search terms. To go
directly to the right portions of the lengthy sections, go to the
Terms box in the lower right corner of your results screen. Click
the arrow to move from search term to search term.
F Quick EDGAR®/SEC
Filing Searches
Find full-text Exhibit 8 and Exhibit 10 filings from EDGARPlus.
G Find Tax Public

Security Death Records; or take a close look at businesses through
Dun & Bradstreet® or Experian® reports and SEC filings. Even check
non-U.S. public records.
Each link on the right side of the Tax Research Tasks page takes you

window to more tax sources. For example, choose from:
1 More Tax Information

LexisNexis®
Research On Call: When You Need an Extra Body ... But Can’t
Add More Staff
OK. You’re two months into 2005 budgets. So far so good?
Or have you had a few surprises
already? Like a couple of brand new cases—big ones with short
research deadlines. Or a library staffer who needed to go on medical
leave three weeks early. You’re happy she and the baby are fine, but
you’re very short-handed and overworked.
LexisNexis Research On Call can
help you manage the ebb and flow of projects and staffing without
adding researchers—and without blowing your research budget. That’s
because you use LexisNexis Research On Call when you need it.
You know the cost in advance; you approve the charges before any
work is completed.
LexisNexis Research On Call
provides your organization* an extra experienced researcher when
needed—just call 24/7 365 days a year.
When you dial LexisNexis Research
On Call at 800-273-9295, a Research Coordinator takes your research
request information. After your request is confirmed, a Research
Specialist will be assigned based on how well their background
matches your topic.
All power users of the LexisNexis
services, Research Specialists also have professional experience and
advanced degrees such as Juris Doctor, Master of Business
Administration and Master of Library Science, or professional
certifications such as Certified Public Accountants and Series 7.
The end product you’ll receive is
in accordance with the time frames agreed upon and in the format you
designated after consulting with LexisNexis Research On Call staff,
including formats that can be virtually presented to your patrons,
such as reports of research findings or a memorandum of law.
In addition to staff shortages and
unexpected research overloads, LexisNexis Research On Call can give
you and your staff temporary bandwidth to handle tasks that require
internal expertise. For example, while you and your staff
manage the research for the two new high-profile cases, LexisNexis
Research On Call specialists can complete research projects that by
their nature are time-consuming, such as:
- multi-state statutory or
regulatory research
- federal or state legislative
history research
- in-depth profile of a company
and its subsidiary for due diligence or merger & acquisition
- profiling of an industry for a
new or potential client
Or maybe you and your team prefer
to handle such major research projects. LexisNexis Research On
Call specialists can also complete more basic but necessary tasks,
including cite checking and verification. Or use LexisNexis Research
On Call specialists to retrieve news stories, press releases, SEC
filings, bankruptcy filings, U.S. and Canadian patents, cases,
statutes, regulations, Private Letter Rulings, etc.
You decide.
Make LexisNexis Research On Call Work for You
- Call 800-273-9295.**
- Describe your research issue
to the research coordinator.
- Check your work order and
confirm the scope of the research, delivery date and cost.
- Your results will be e-mailed
to you—ready to download or print.
That’s it until the next time you
call. Pricing is based on two components—search charges and a
professional services fee. The search charges come from the terms
and rates of your organization’s current LexisNexis subscription
plan. The professional service fee is determined by the number of
hours that it takes to complete the project at $140 per hour
(minimum of $35).
* LexisNexis Research On Call is
not currently available in academic institutions or government
facilities.
**If this is your first time using LexisNexis Research On Call, you
will need to complete
the Master Service Addendum (MSA). There is no fee to do this, but
it is necessary to comply with additional Terms and Conditions.
