KNOWLEDGE EXCHANGE . . . LexisNexis® Now the
Exclusive Provider of Factiva® Content in the Legal Market
By
Susan Skyzinski
Senior
Librarian Relations Consultant,
LexisNexis Librarian Relations Group
Let’s face it—information is the cornerstone librarians rely on
for all our research needs.
The information and sources we depend on establish a value for the
projects and services
we provide to our attorneys and their clients.
Whether the research we conduct is global or local, reliable
content is critical. LexisNexis understands this, and our recent
long-term agreement with Factiva demonstrates our commitment. Now
LexisNexis is the only online provider to offer the legal market
access to Factiva news sources.*
Find More of the World’s Top News Sources
Arguably the leading U.S. financial newspaper, The Wall Street
Journal®, exemplifies this concept with an exceptional
reputation for quality business intelligence. I can’t think of
another publication that has the same type of immediate name
recognition. Where else do
you go for the day’s business news, but to The Wall Street
Journal?
Reuters®, another outstanding resource recognized as the largest
international news agency, offers updated wire stories from every
corner of the world. What a powerful tool to use as you literally
discover international events being reported as they occur.
Background information is critical in today’s business
environment. We have all received that frantic request for the
article in today’s paper about XYZ client and their deal with ABC
Corp. because an attorney wants to perform a due diligence search.
Or remember:
- the partner who approaches you with a need for a
market/industry report for French telecommunications.
- the paralegal who asked you for a stock listing on the
Johannesburg Stock Exchange.
- the marketing director’s request for the article in the
Globe and Mail about the opening of the firm’s new Canadian
office.
Our ability to research an entity to the fullest extent not only
improves the business relationship, it also opens the door to new
opportunities in client development, rainmaking, marketing and the
day-to-day business of our own organizations.
As librarians, we know that the service nature of our profession
tasks us with always having the right information available at the
right time. With the addition of sources such as The Wall Street
Journal, Dow Jones® and Reuters newswires, and, eventually, even
more sources to the 20,000+ available through www.lexis.com,
the LexisNexis® Total Research System strengthens its collection and
becomes an even greater and more integral part of our information
arsenal.
* LexisNexis is the exclusive provider of Factiva
content in the legal market. Factiva content includes the sources
mentioned in this article. These sources may be able to be accessed
via other services, including each vendor’s online services.
SEARCH
STRATEGIES . . . Here’s Where to Find More than 400 News Sources
from Factiva ... and How to Research Them Effectively
Check out the complete list of new sources from Factiva now
available through www.lexis.com. Turn to the flyer enclosed with
this LexisNexis Information Professional Update.*
These additions will be available in three group sources. Plus,
major resources, such as The Wall Street Journal, Dow Jones and
Reuters newswires, etc., will be available in a special group
source. About 25 major resources will also be available immediately
as individual sources.
Mega News Group Sources
Select the NEWS & BUSINESS tab, and you’ll discover these new group
sources:
- Mega News, Most Recent 90 Days
- Mega News, Most Recent Two Years
- Mega News, All
- Major Publications
Each new Mega News group source is comprised of the existing News
group source plus the new Factiva publications. For example, Mega
News, Most Recent 90 Days offers the LexisNexis sources from News,
Most Recent 90 Days plus the new Factiva publications.
The Major Publications group source offers more than 160 resources
from around the globe, sources from Factiva as well as other
publishers. Find The Wall Street Journal, The New York Times®,
The
Washington Post®, Los Angeles Times®, Chicago Tribune®,
Financial
Times®, CNN transcripts, Barron’s®, and much more. For
a complete listing, click on the “i” icon next to Major Publications
on the News menu.
Mega News Group Sources—Research Tips
Use your favorite LexisNexis searching techniques in the new Mega
News group files.
For example, find information on any topic, e.g., the recent mobile
phone partnership between Microsoft Corp. and Flextronics
International to produce the new “Peabody” phone platform:
SOURCE: Mega News, Most Recent 90 Days
SEARCH: microsoft /20 flextronics AND peabody
Because the Mega News group sources offer thousands of publications,
you can also use familiar segments to refine your search. For
example, to restrict your research to a specific date:
SOURCE: Mega News, Most Recent 90 Days
SEARCH: microsoft /20 flextronics AND peabody AND date is 2/14/2005
Or use segments to restrict your research to specific publications:
SOURCE: Major Publications
SEARCH: social security /10 privatiz! AND PUBLICATION(wall street
journal OR new york times OR washington post OR chicago tribune OR
los angeles times)
Or use the FOCUS™ feature to pinpoint specific topics. For example,
in the last search, you could use the FOCUS feature to find
discussions of personal Social Security accounts. Add AND personal
accounts to your search
in the FOCUS box at the top of your screen. Then click GO.
Here’s more helpful news. New publications from Factiva all include
LexisNexis SmartIndexing Technology™ terms as well as Factiva
indexing terms. Use either in your research. For example:
SOURCE: Mega News, Most Recent 90 Days
SEARCH: SUBJECT(sarbanes oxley) AND disclos! /10 pay OR
salary OR compensat! OR perk OR perquisite /10 executive
You can even use advanced LexisNexis SmartIndexing research
techniques, e.g.:
SOURCE: Mega News, Most Recent 90 Days
SEARCH: SUBJECT(reverse mortgages PRE/1 8*% OR 9*%)
This search will find articles with major discussions of “reverse
mortgages.”

Technology in your research, go to www.lexisnexis.com/infopro/smartindexing

Individual Sources—Research Tips
Once again ... familiar LexisNexis research features are available.
For example, select a single file:
SOURCE: The Wall Street Journal
SEARCH: eminent domain
Use segments to restrict your search. Or use the FOCUS feature to
refine. In the search above, for example, add connecticut OR new
london in the FOCUS box at the top of the results screen and click
GO.
Some publications are available to combine into custom group
sources.
For example, to research Dow Jones Asian Equities Report and
Dow
Jones Chinese Financial Wire simultaneously, click the Show
checkboxes for combining sources link on the menu screen where both
sources appear. (Only sources available to combine will have active
checkboxes.)
Check the boxes next to Dow Jones Asian Equities Report and
Dow
Jones Chinese Financial Wire and click Combine Sources. Then enter
your search, e.g.:
SOURCE: Dow Jones Asian Equities Report, Dow Jones Chinese Financial
Wire
SEARCH: mobile OR cell! /2 phone OR telephone /10 picture OR camera
As in the group sources, you can also use Factiva indexing terms or
LexisNexis SmartIndexing terms to pinpoint specific concepts,
people, companies or geographic locations. For example:
SOURCE: Reuters News
SEARCH: TERMS(vietnam AND hotels & motels) AND flu OR influenza
OR sars
TERMS is a group segment name. You can use TERMS with any Factiva
or LexisNexis SmartIndexing term, including people and company
names, geographic terms and subject terms, e.g., HOTELS & MOTELS.
Get the Complete Picture—Graphics from The Wall Street Journal!
When you search The Wall Street Journal at www.lexis.com, selected
articles will include charts, graphs and photos. Find these
additions appended to the end of the article.
*Sources provided through Factiva will not be available on
LexisNexis law school menus and will not be available to Corporate
Legal subscribers.

Shepard’s® Citations Service Now Highlights Serious “Questioned By”
Analysis
Shepard’s Citations Service
now provides even more detailed editorial analysis.
The editorial phrase “Questioned
By” now appears as a separate Shepard’s Signal™ Indicator—an
Orange “Q,” in addition to the red, yellow and green signal
indicators shown in the Shepard’s Summary at the top of your
case’s Shepard’s report.
Click on the Questioned link
in the summary and move to the first citing reference with that
analysis.
The “Questioned By” editorial
phrase existed previously in Shepard’s Citations Service,
generating a red “Warning” signal. Its definition:
The citing opinion questions the
continuing validity or precedential
value of the case you are Shepardizing™ because
of intervening
circumstances, including judicial or legislative
overruling.
In other words, the citing court believes that a case or new
legislative or regulatory development has come along, impacting some
or all of the case you Shepardized™ negatively. Because the
“Questioned By” phrase represents a court’s interpretation (as
opposed to that of a commentator, law review, editor, etc.) the
phrase is a serious notation.
Now when you look at the
Shepard’s Summary, “Questioned By” references stand on their own
to draw attention to their unique importance and to help you assess
their impact on your research. In short, you get more upfront
analysis to guide you as you research further.
“Questioned By” is also defined
with the rest of the signal indicators in the Legend link at
the bottom of your report. Also find it in the lower navigation bar.
Click on the drop-down arrow next to Cites, then highlight
Questioned under Negative analysis. Move directly to the first
citing reference with “Questioned By” analysis.
There’s more! Find Restatements
References in Shepard’s
Now Restatement Annotated Case Citations are listed among the
potential citing references for the cases you Shepardize®.
Restatements have been cited in the
common law in excess of 125,000 instances, and each citation is
analyzed by the American Law Institute. The Institute provides the
citing court, cite, date and a summary of the citing case.
Additionally the Institute provides an analysis of which Restatement
Rule (or part thereof) was cited and how it was treated. (For
example, Comment C of Section 402A, Torts cited in dissenting
opinion.)
SPOTLIGHT ON . . . Handcrafting
the User-Friendly Index: A Look at the Matthew Bender®
Indexing Team
(Joseph Schneider, an index
supervisor in the Matthew Bender Newark Office, asked for this
opportunity to introduce the Matthew Bender indexing staff to their
librarian subscribers.)
So ... how do you find your way through a 50-volume legal treatise,
particularly if these volumes are filling library shelves rather
than occupying cyberspace? The traditional back-of-the book index.
Matthew Bender prints approximately
1,300 titles, most with indexes that have been created and are
maintained by a staff of indexers. They use their expertise to
ensure you get to needed information and analysis quickly and
accurately.
Matthew Bender indexers are located
in Newark, NJ and San Francisco as well as in Charlottesville, VA,
where indexers work primarily on state codes and other primary
source publications.
Profile of an Indexer
Working on secondary sources from Newark and San Francisco, the 20+
in-house index editors, index supervisors and Index Manager Karin
Newton come from an impressive array of backgrounds. Almost half are
attorneys, and most others have some paralegal training. The
majority of indexers have post-graduate degrees, often in
literature.
We are also self-proclaimed “legal
junkies” who enjoy reading about, analyzing and interpreting legal
issues. We consider it a labor of love to stay up on the hot issues
in our areas of law.
And we work hard to maintain
proficiency with the necessary technology, including the indexing
program, CINDEX, and its associated utilities, file management
systems, print composition programs, Microsoft® desktop products,
and an assortment of others.
How Does the Work Get Done?
Matthew Bender publications are updated on an as-needed basis,
generally between one and four times a year. Treatises may be one
volume, but the largest is 159 volumes, and the accompanying indexes
run from one to 2,500 pages, with an average length of about 500
pages.
Publications are generally in
loose-leaf format, with five-ring binders so subscribers can receive
updated pages rather than the entire publication at each new
release.
Obviously when the publication’s
text changes, the index may have to be revised as well, depending on
the substantiality of the changes. While new indexes for new
publications are created yearly, most work involves updating
existing indexes.
Each year’s releases are divided
among the index editors, who are associated with a team of legal
editors specializing in particular areas of law.
Index editors generally work on
four to five indexes simultaneously and are responsible for 75 – 80
releases per year. In addition to composing the index, they check
the proofs and review the CD and online indexes as they become
available as well.
What About Online Indexes?
This is the single most crucial and exciting development for
indexers. Since Matthew Bender’s print publications have gone
online, many customers (mostly you!) have requested that we move our
print indexes online.
We understand why.
“These print-based indexes are
manually crafted by legal indexers who read every chapter page in
the publication. As a result, the indexes reference key terms only
when there has been a substantive discussion of that key term,” says
Karin Newton.
So a few Matthew Bender indexes
have joined the LexisNexis online offering, including Moore’s
Federal Practice®—Civil: Index and several state volume indexes.
But watch for more. The Indexing
team is enhancing the functionality (e.g., precise linking to the
specific subheadings cited in the index) to ensure precise and
user-friendly interface with the text.
And keep in mind ... you can
browse any Matthew Bender index at www.lexis.com WITHOUT
CHARGE. Only when you retrieve a full-text treatise section do
you incur a document-retrieval charge.

THRIFTY SEARCHER . . . Use LexisNexis
SmartIndexing Technology™ Terms to Pinpoint Geographic Locations
Dear Thrifty Searcher:
I’m pretty comfortable using LexisNexis SmartIndexing
(Technology) terms in searches so I better pinpoint articles on a
topic or specific person. Now ... can I also use SmartIndexing terms
to refine my search to particular countries, cities or states?
Sincerely,
(name withheld on request)
Dear Librarian Colleague:
With LexisNexis SmartIndexing Technology terms, you can search with
approximately 950 geographic locations. That includes:
- All countries
- All states in the United
States, Germany, India and Australia
- All provinces in Canada and
China
- Capital cities for all
countries, territories, possessions, states and provinces
- All cities worldwide with a
population greater than one million
- Continents and regions
For example, you could enter:
CITY(baghdad) AND SUBJECT(election)
STATE(ohio) AND SUBJECT(pork)
COUNTRY(africa) AND SUBJECT (“oil gas exploration”)
You can also use the GEOGRAPHIC group segment, for example:
GEOGRAPHIC(ohio) AND SUBJECT(pork)
To search for a specific region or continent, you can enter the name
in the COUNTRY segment. The continent/region terms are written to
capture documents that discuss that area, e.g., Europe or Africa.
Or you can broaden your search and
retrieve stories that discuss every country within a continent or
region. Just use one of the codes listed below. These codes capture
any story that is tagged with a country that makes up a
particular continent or region.
For example, to find articles about
the telecommunications industry in Central Europe:
ENTER: #gr153# AND SUBJECT(telecom!)
