ONLINE WITH . . . Shepard’s® Citations Service Now Highlights Serious “Questioned By” Analysis

Shepard’s Citations Service now provides even more detailed editorial analysis.

The editorial phrase “Questioned By” now appears as a separate Shepard’s Signal™ Indicator—an Orange “Q,” in addition to the red, yellow and green signal indicators shown in the Shepard’s Summary at the top of your case’s Shepard’s report.

Click on the Questioned link in the summary and move to the first citing reference with that analysis.

The “Questioned By” editorial phrase existed previously in Shepard’s Citations Service, generating a red “Warning” signal. Its definition: 
 
      The citing opinion questions the continuing validity or precedential
      value of the case you are Shepardizing™ because of intervening
      circumstances, including judicial or legislative overruling.

 
In other words, the citing court believes that a case or new legislative or regulatory development has come along, impacting some or all of the case you Shepardized™ negatively. Because the “Questioned By” phrase represents a court’s interpretation (as opposed to that of a commentator, law review, editor, etc.) the phrase is a serious notation.

Now when you look at the Shepard’s Summary, “Questioned By” references stand on their own to draw attention to their unique importance and to help you assess their impact on your research. In short, you get more upfront analysis to guide you as you research further.

“Questioned By” is also defined with the rest of the signal indicators in the Legend link at the bottom of your report. Also find it in the lower navigation bar. Click on the drop-down arrow next to Cites, then highlight Questioned under Negative analysis. Move directly to the first citing reference with “Questioned By” analysis.
 
There’s more!  Find Restatements References in Shepard’s
Now Restatement Annotated Case Citations are listed among the potential citing references for the cases you Shepardize®.

Restatements have been cited in the common law in excess of 125,000 instances, and each citation is analyzed by the American Law Institute. The Institute provides the citing court, cite, date and a summary of the citing case. Additionally the Institute provides an analysis of which Restatement Rule (or part thereof) was cited and how it was treated. (For example, Comment C of Section 402A, Torts cited in dissenting opinion.)


SPOTLIGHT ON . . . Handcrafting the User-Friendly Index:  A Look at the Matthew Bender® Indexing Team

(Joseph Schneider, an index supervisor in the Matthew Bender Newark Office, asked for this opportunity to introduce the Matthew Bender indexing staff to their librarian subscribers.)

So ... how do you find your way through a 50-volume legal treatise, particularly if these volumes are filling library shelves rather than occupying cyberspace? The traditional back-of-the book index.

Matthew Bender prints approximately 1,300 titles, most with indexes that have been created and are maintained by a staff of indexers. They use their expertise to ensure you get to needed information and analysis quickly and accurately.

Matthew Bender indexers are located in Newark, NJ and San Francisco as well as in Charlottesville, VA, where indexers work primarily on state codes and other primary source publications.

Profile of an Indexer
Working on secondary sources from Newark and San Francisco, the 20+ in-house index editors, index supervisors and Index Manager Karin Newton come from an impressive array of backgrounds. Almost half are attorneys, and most others have some paralegal training. The majority of indexers have post-graduate degrees, often in literature.

We are also self-proclaimed “legal junkies” who enjoy reading about, analyzing and interpreting legal issues. We consider it a labor of love to stay up on the hot issues in our areas of law.

And we work hard to maintain proficiency with the necessary technology, including the indexing program, CINDEX, and its associated utilities, file management systems, print composition programs, Microsoft® desktop products, and an assortment of others.

How Does the Work Get Done?
Matthew Bender publications are updated on an as-needed basis, generally between one and four times a year. Treatises may be one volume, but the largest is 159 volumes, and the accompanying indexes run from one to 2,500 pages, with an average length of about 500 pages.

Publications are generally in loose-leaf format, with five-ring binders so subscribers can receive updated pages rather than the entire publication at each new release.

Obviously when the publication’s text changes, the index may have to be revised as well, depending on the substantiality of the changes. While new indexes for new publications are created yearly, most work involves updating existing indexes.

Each year’s releases are divided among the index editors, who are associated with a team of legal editors specializing in particular areas of law.

Index editors generally work on four to five indexes simultaneously and are responsible for 75 – 80 releases per year. In addition to composing the index, they check the proofs and review the CD and online indexes as they become available as well.

What About Online Indexes?
This is the single most crucial and exciting development for indexers. Since Matthew Bender’s print publications have gone online, many customers (mostly you!) have requested that we move our print indexes online.

We understand why.

“These print-based indexes are manually crafted by legal indexers who read every chapter page in the publication. As a result, the indexes reference key terms only when there has been a substantive discussion of that key term,” says Karin Newton.

So a few Matthew Bender indexes have joined the LexisNexis online offering, including Moore’s Federal Practice®—Civil: Index and several state volume indexes.

But watch for more. The Indexing team is enhancing the functionality (e.g., precise linking to the specific subheadings cited in the index) to ensure precise and user-friendly interface with the text.

And keep in mind ... you can browse any Matthew Bender index at www.lexis.com WITHOUT CHARGE. Only when you retrieve a full-text treatise section do you incur a document-retrieval charge.

With LexisNexis SmartIndexing Technology terms, you can search with approximately 950 geographic locations. That includes:
