Read the Full Text of the Public Law—or Just Sections of Interest
To retrieve the full text of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, U.S. Public Law 109-8, select the GET A DOCUMENT tab. ENTER: 109 us 8 and click GET.

The law is more than 200 screen pages, so use the FOCUS™ feature to pinpoint topics of interest. For example, to find sections of the law addressing cross-border bankruptcies, go to the FOCUS terms box at the top of your screen, ENTER: cross! /5 border and click GO.

Now move directly to the sections that discuss cross-border bankruptcies. Use the term navigation box. On the bottom right side of the screen, find the number of term occurrences, e.g., 8. To move from 1 to 8 quickly, ENTER: 1 in the box next to Terms. Then click GO. Now you’re at the first occurrence of your search terms. To move to the next, click the right arrow. To move back to an occurrence, click the left arrow.

Follow Court Docket Developments
Most of the provisions of the Bankruptcy Abuse Prevention and Consumer Protection Act take effect in October. You can monitor U.S. bankruptcy activity before and after effective dates in specific jurisdictions or in particular judges’ courts with the LexisNexis® CourtLink® service. Use the Search function to narrow your research to specific bankruptcy courts. Search dockets by:

  • bankruptcy type (Chapter 7, Chapter 11, Chapter 12 and Chapter 13)
  • disposition (filed, discharged, dismissed, etc.)

Click the Browse TOC link next to the SEARCH button. Rest your cursor on the + next to Chapter 7: Experts. The pop-up box lets you choose to open one, two or all levels of the ETOC. You do not incur document-retrieval charges until you open a full-text treatise section.

Or you can search the ETOC to find all mentions of experts. To search the ETOC, in the search box at the top of the screen, ENTER: expert

Click the Table of Contents (TOC) Only radio button. Then click SEARCH.

Now look at your ETOC! The condensed ETOC results show every level—down to subsections—where your search words appear. Plus you see adjacent levels for context.

This view is called TOC Hits. Each entry, blue or black, is a link. Plus, you can move between the TOC Hits and TOC views with the display format links at the top of the screen.

You can also search the full-text treatise. On the search screen, click the Full Text of Source Documents radio button. Enter your search, for example, to find sections that discuss FRCP Rule 26 (b)(1) covering disclosure and discovery, ENTER: 26 /5 b

Look at the treatise sections you find. Note that you can link directly to the full text of Rule 26(b)(1) as well as to full-text cases discussed. Plus bi-directional footnotes make it easy to check notes and return to your research.

2) See the Headline First in News Cite Display Format
Now you can change the order of the Cite display when browsing news search results.

The headline of news articles can appear first in the cite list, so you can scan your answer set more quickly.  Or you can keep your current Cite display and review every instance where your search words appear.

Currently news cite information appears in the following order:

  1. Publication
  2. Date
  3. Section, Volume, etc.
  4. Headline

But click on the Hide Hits link at the top of your results screen, and view headlines first. Articles are still delivered in reverse chronological order by date then alphabetical by publication. Cite information will display in the following order:

  1. Headline
  2. Publication
  3. Date
  4. Volume or section
  5. Page number
  6. Number of words

To return to the standard Cite display with publication title first, click the Show Hits link.

THRIFTY SEARCHER . . . DISPOSITION Segment Now a Group Segment

Dear Thrifty Searcher:
When searching case law via (the) LexisNexis (services), I notice that many full-text cases show a Disposition line (segment) as well as an Outcome paragraph (in the case summary). Each says similar things, though they don’t match exactly. So when I search for cases that were affirmed or reversed, should I use both Disposition and Outcome in my request to ensure that my results are complete?

Dear Kansas City:
The simple answer is … use the DISPOSITION segment when focusing your research to a specific case disposition or outcome.

Now let us explain: There are two places where disposition information about the case is shown—the DISPOSITION segment and the OUTCOME segment of the LexisNexis® Case Summary.

Some cases offer both segments. In these cases, the court provides a specific disposition phrase. (By the way, LexisNexis reproduces these phrases exactly as the court provides them.) And LexisNexis editors also include detailed disposition language in the OUTCOME segment of the LexisNexis Case Summary.

However, not every court provides the disposition phrase; some cases have only the OUTCOME segment provided by LexisNexis editors.

That doesn’t change our answer. You still only need one segment name when searching. Here’s why. Now when you research with the DISPOSITION segment, the LexisNexis services searches both—the documents’ OUTCOME segments as well as the DISPOSITION segments. Think of the DISPOSITION segment as a group segment.

The opposite is not true. When you search with the OUTCOME segment,
you do not search the DISPOSITION segment as well. You search only the OUTCOME segments.

Here’s how DISPOSITION segment searching works. Let’s say you’re researching U.S. and state Labor & Employment cases regarding ADA reasonable accommodation procedures employers must provide workers with alcoholism. Your search:

After reviewing your results, you want to narrow your research to cases that were reversed. To check both DISPOSITION and OUTCOME segments, go to the FOCUS feature box at the top of the screen, and after your search:

Click GO. To return to your original search results, i.e., before you entered the FOCUS feature, click the Exit FOCUS link.
