LIBRARIAN TO LIBRARIAN . . . A Special Message Regarding Hurricane Katrina…

Dear Colleagues:

Hurricane Katrina devastated families and homes, and destroyed or disrupted many business operations. It is heartbreaking, and LexisNexis and its employees offer their sympathies to all those affected.

We know our thoughts and prayers alone won’t rebuild homes or restore business operations, so in addition to company efforts to raise funds and send volunteers to assist, LexisNexis also has established a variety of hurricane-relief programs for our legal customers.

One of the biggest challenges during an ongoing crisis such as this is gaining access to accurate, up-to-the minute news. To help meet this need, LexisNexis has expanded its free online news site (LexisNexis U.S. Politics & World News) to include in-depth coverage of all aspects of this event and the ongoing remediation efforts. Visit http://www.lexisnexis.com/news/ to get the latest Katrina news from more than 4,000 U.S. and international news sources.

I’m telling you about our efforts here because the law librarian network is so strong. We all know librarian and legal industry colleagues whose firms, law schools, courts, agencies and corporations have been affected.

Below is a summary to help familiarize you with LexisNexis Hurricane Relief programs. If your organization has been affected by this storm, please take advantage of these programs. If not affected, please feel free to reach out to colleagues who are and let them know how we can help.

Currently LexisNexis offers the following to subscribers affected by Hurricane Katrina:

• FREE ACCESS FOR RESEARCH: Thirty-day IDs for complimentary access to
www.lexis.com are available. Go to www.lexisnexis.com/katrinarelief/ for more information.

• CUSTOMER SUPPORT ACCESS: Legal researchers without online access to the LexisNexis® services can receive assistance through a toll-free research hot line staffed 24/7 by LexisNexis® Customer Support. Call the hot line at 866-749-0883, Option 1.

• PRINT PRODUCT REPLACEMENTS/DISCOUNTS: Current subscribers will be offered FREE replacement of LexisNexis print publications destroyed by the hurricane. Lapsed customers will be offered a 50 percent discount, while new customers or those using other print providers will receive a 40 percent discount on LexisNexis print publications. Call 866-749-0883, Option 2, for more information. (NOTE: All product shipments, billing documents and business mailings have been suspended to affected areas based on information provided by the United States Postal Service. LexisNexis is providing other assistance to law students affected by the hurricane, including FREE course books to all displaced students. LexisNexis will also provide free copies of relevant titles from the LexisNexis® Understanding Series and Q & A Series to all displaced students. Affected students should contact their local LexisNexis representative for more information.

Law students are able to donate LexisNexis® Ultimate Rewards (LNUR) points to the Red Cross Hurricane Katrina Relief Effort through the law school portal at http://www.lexisnexis.com/lawschools.

LexisNexis is committed to working with our customers and colleagues impacted by this storm. It’s how you know we care.

2) LexisNexis Enters Exclusive Alliance with the National Institute for Trial Advocacy

Together, LexisNexis and the National Institute for Trial Advocacy (NITA) will provide cutting-edge practical education to attorneys and law students who attend NITA trial advocacy programs and use NITA materials.

About the National Institute for Trial Advocacy
Founded in 1971, NITA, a non-profit educational organization, is internationally recognized for producing the finest trial advocacy training programs and materials for attorneys and law school students.

NITA’s programs are taught by a faculty of more than 700 professors, judges and leading law firm litigators who excel in training and mentoring attorneys in trial and other advocacy skills.

In fact, over the past 33 years, NITA has trained more than 80,000 attorneys through in-house programs, dedicated public service programming, and international outreach.

The Value to Law Firms
The leading legal, news and business resources your patrons access via the LexisNexis services are a natural complement to the premier hands-on skills training offered in NITA’s public and in-house programs. By experiencing the use of such resources in the context of particular litigation-related tasks (e.g., taking depositions, brief writing, and trial advocacy), program attendees will better understand how the success of those tasks can be affected by the strategic utilization of online resources.

Early Successes…From Attorneys’ Perspectives
LexisNexis has already contributed online research sessions to several of NITA’s public deposition programs. For instance, this summer LexisNexis representatives presented several sessions on how to conduct online research on expert witnesses at NITA’s Expert Witness Deposition programs.

Attendee comments included:

  • I thought it was very useful for both finding an expert and researching the other side’s experts.
  • [I] thought this presentation was very helpful, and [the] information I learned I will be able to use in my practice.
  • Good presentation. I learned a lot.
  • It was good, valuable information.

Upcoming Programs
Both LexisNexis and NITA are aggressively evaluating additional ways to collaborate that will take advantage of their respective areas of expertise. For instance, LexisNexis and NITA are currently exploring the development of a truly unique “hands on” CLE offering in the area of electronic discovery. In addition, LexisNexis and NITA will work together to publish new titles and extend valuable LexisNexis offers to alumni of NITA programs.

KNOWLEDGE EXCHANGE ... LexisNexis® Alert Feature: Be Focused … Be Current … Be Correct

By Raul Lopez, LexisNexis Librarian Relations Consultant

When I was a reference librarian at a law firm, being focused, being current and being correct were the standards I lived by.

Needless to say, these standards were tested on a daily basis as I became inundated with new research sources, new technologies, new research assignments and a host of other issues to troubleshoot.

So when a technology or product enhancement came along that made my life easier, I jumped at the chance to implement it into my workflow. After all, being efficient was also a top priority.

In my law firm days, the LexisNexis® ECLIPSE™ feature helped me to stay on top of events of importance to the firm and to the library. Just set up the ECLIPSE search, and get regular, automatic information updates.

Now there’s even more functionality—and more time-saving features to make reference librarians’ jobs all across the globe easier.

LexisNexis ECLIPSE is now the LexisNexis Alert feature. (See last month’s feature in the LexisNexis Information Professional Update for complete how-to details.) And you can monitor breaking news up to three times a day. Your organization stays current … and responds in a more timely fashion.

Conversely, should no article meet your criteria—sometimes no news is news—the new LexisNexis Alert feature gives you the option to receive an e-mail notification stating just that.

Of course, just because you want more articles throughout the day doesn’t mean you want to spend hours reviewing duplicates. The new Alert feature makes it easy to remove duplicates; it just takes the click of a button during the one-screen set-up process.

You can also save a search for Alert update—even if the search did not generate any initial results! For all librarians monitoring corporate deals, litigation matters or legislation, what a relief to know that more than 20,000 news sources are monitoring your topic. If something breaks, you’ll find out.

And not only has the LexisNexis Alert feature improved how librarians monitor news, it has also improved how we monitor cases. The Alert feature has extended to Shepard’s® Citations Service, enabling librarians to monitor case law effortlessly.

With a Shepard’s Alert™, you decide what’s important to track. Do you just want to be notified of future negative treatment or all new citing references? Simply check the appropriate boxes and save the Alert search.

Keeping track of your Shepard’s Alerts is also simple. On the Shepard’s Alert sub-tab, you have the options to edit, delete, or pause the Shepard’s Alert. It’s that simple.

Are you also responsible for tracking newly filed cases? LexisNexis® CourtLink® Alerts are now integrated into your lexis.com® research. Monitor all of your Alert searches—lexis.com, Shepard’s and CourtLink—from one central location. Just click the ALERTS tab on the main menu at www.lexis.com. Once you sign on to www.lexis.com, you can select CourtLink Alert and be authenticated automatically into the CourtLink service.

  • Using LexisNexis® Headnotes in Shepard’s® Citations Service;
  • Setting up LexisNexis, new Shepard’s or CourtLink Alerts—from the same research tab.

Carol Barra, LexisNexis Librarian Relations Consultant from New York,
and Linda Hutchinson, LexisNexis Senior Librarian Relations Consultant from Washington D.C., will present.

Register for LexisNexis Year in Review: A Top-Ten Countdown at www.lexisnexis.com/webseminars

After registering, you’ll receive an e-mail confirmation. On November 16, watch for a reminder e-mail with instructions on how to gain access to the seminar and materials. Each seminar will be recorded, and the recording will be made available along with the presentation materials via the LexisNexis InfoPro Web site.

THRIFTY SEARCHER . . . Link from USCS History to Public Laws

Dear Thrifty Searcher:
My LexisNexis Librarian Relations Consultant just showed me how to link from a USCS section’s history to the amending law. Wow! You should definitely share that with your Thrifty Searcher readers. It saved time and research budget for me.

                                                Sincerely,
                                                Legislative History Researcher

Dear History Researcher:
If you regularly study how legislation has enacted or amended a particular USCS section, please note: the task is now simpler. Now you can link to U.S. Public Law information found in the HISTORY segment of United States Code Service sections.

That means more than 525,000 new links have been added to USCS sections so you can move directly from the USCS to enacting or amending legislation. (That means that instead of searching Congressional bill-text files or U.S. Public Law files, you click the link and move to the document you need.)

For example, when you look at the full text of 8 USCS §1101 you’ll note there is a USCS Practitioner’s Toolbox on the right side of the statute section. The toolbox, which displays in the FULL mode, is unique to that statute.  It only displays links for section headings that occur in that statute. Use the toolbox links to navigate lengthy sections efficiently. (For more on using the USCS Practitioner’s Toolbox, see the July 2005 LexisNexis Information Professional Update.)

To move directly to the History segment of 8 USCS §1101, just click the History link.

Now you’re ready to link to statute amendments—from the first revision in 1952 to the most recent.

Let’s say you’re interest in determining how the Intelligence Reform and Terrorism Prevention Act of 2004, P.L. 108-458, affected this code section. The History notation states that Title V, Subtitle E, §5504 of the Public Law amends 8 USCS §1101.

To see the amending language, click the P.L. 108-458 link. Now you have the full text of the U.S. Public Law.

Many public laws are extensive; this one has more than 200 screen pages. But move to §5504 easily. Look at the bottom navigation bar. Next to the Page box, select pagination for 108 P.L. 458. In the next box:

ENTER: 5504
CLICK: GO

To return to your UCSC section for more history research, select your research History link in the upper right corner of your screen.

The full text of U.S. Public Laws passed prior to 1988 are available as PDF documents. For example, as you view the history of 8 USCS §1101, you click the P.L. 94-571 link to see section revisions passed Oct. 12, 1976. Then click the PDF link. (At this time, the PDF documents are not searchable.)
