1)LexisNexis® PatentOptimizer™ 3.0 Introduces Enhancements for Patent Prosecution as well as Patent Litigation
Do you ever think of your organization’s patent team as unsung heroes? They protect intellectual property rights that translate into millions of dollars worth of R&D investment and potential revenue. And market trends indicate that IP work will proliferate due to the global economy expansion, continued new product development and branding strategies, and increased IP legislation/regulation.
In short, Intellectual Property attorneys must be able to manage increasingly large portfolios of patents and trademarks and be confident they can protect these highly valuable assets. What can you do to help them? What value can you add?
Check out the LexisNexis® PatentOptimizer™ service. Even if you’ve seen PatentOptimizer, the newly released version 3.0 is worth another look.
PatentOptimizer is a revolutionary, automated way to construct and deconstruct patents. Created by patent attorneys for patent attorneys, PatentOptimizer is unique in the field of patent solutions; it is designed for patent prosecution as well as patent litigation. PatentOptimizer allows for analysis and validation of the actual patent application as it’s being drafted through Microsoft® Word—or for on-the-fly analysis and validation of granted patents through Internet Explorer.
Even if your organization doesn’t handle all its patent prosecution work, PatentOptimizer can help monitor the general quality of patent applications prepared by law firms on its behalf.
Plus PatentOptimizer is closely integrated with other LexisNexis® and Reed Elsevier products and services, including:
- the LexisNexis online patent collection,
- LexisNexis IP case law,
- Matthew Bender® treatises,
- Ei Compendex® thesaurus,
- CourtLink® docket searching and tracking,
- REEDFAX® for ordering patent file history information, and
- HotDocs® document automation.
2) Here’s an Overview of New Enhancements to the PatentOptimizer 3.0 Toolbar
The LexisNexis PatentOptimizer service is now two years old—and even more powerful with new features and major enhancements driven by feedback from IP professionals.
Check References—Enhanced!
This powerful tool identifies all patent citations included in an application or grant and publishes the related patent bibliographic information along with assignee and post issuance data (e.g., notices of litigation, reissues, requests for re-examinations, expirations for failure to pay maintenance fees, etc.)
Now Check References also supports the USPTO EFS-Web IDS form for electronic filings.
Check Claims—Enhanced!
The enhanced Check Claims tool helps you analyze the antecedent basis and automatically research specific claim elements in the prior art.
Plus the new Claim Tree and Search Claims function lets you:
- selectively display claim elements within the claim hierarchy;
- retrieve comparable claim language in the prior art; and
- capture and associate prior-art reference data, users’ notes and bibliographic
info (from a variety of Web sources) within the context of the claim hierarchy.
Compare Claims—New!
Get quick comparison of claim elements, terms and phrases across multiple documents to easily detect new and deleted matter. View multiple claim hierarchies and quickly detect improper new matter or deleted matter.
Check Measurements—New!
The new Check Measurements tool automatically converts common English measurements into metric. It also flags errors in your conversion entry.
Check Parts—Enhanced!
Now you can:
- detect part references across descriptions, claims or abstract;
- automatically insert part numbers into parts appearing in the description, abstract and claims;
- perform quick shorthand notations with the new Insert Part Names feature.
Check Terms—Enhanced!
The User Dictionary has been enhanced to let users import their own dictionary of terms. PatentOptimizer checks it against documents and gives you a findings report you can use to identify potential areas of concern—or automatically generate a glossary for insertion into a patent application.
In addition to the enhanced tool functions, you can continue to utilize the other LexisNexis PatentOptimizer features, including:
Mark Terms
Loads the Attorney’s Dictionary of Patent claims, Ei Compendex Thesaurus and Lexis® case law annotations, then scans the document and highlights relevant terms that match.
LexisNexis Patent Research
Click to launch the LexisNexis® Patent Research Tasks Page, which combines vital LexisNexis Intellectual Property sources into one, easy-to-access menu page.
Web Search
Search a multitude of search engines for particular terms or phrases within a patent.
Dictionary and Thesaurus
Link to some of the most popular dictionaries and thesauri on the Internet.
Patent Citation
Insert fully formatted patent citations into your document automatically, including a hyperlink.
Mark Claims Wizard
Enables the “Update Claims References” feature and links dependent claim references to their parent claims.
Update Claims References
Renumbers claims and claim references to reflect recent updates/amendments made to the claims.
Remove Markup
Removes the hypertext markup from marked claims and linked citations.
SEARCH STRATEGIES . . .News Resources Consist of Negative Business, People Reports
Sometimes the bad news is the news you need. For due diligence, for Sarbanes-Oxley “Know Your Customer” requirements, for litigation prep—even for client development—negative news about people and businesses can be essential. Too bad you can’t search for bad /5 news and get comprehensive or accurate results.
But you can pinpoint important negative information about an individual or business through LexisNexis News & Business sources—without lengthy, complicated search strings.
Two new Negative News sources are derived from the Mega News group file and include more than 22,000 news sources, including Factiva® news sources. Select Mega News, Negative Personal News (short name: NEWS;MGANPN) to find adverse or unfavorable news relating to a specific person. Mega News, Negative Business News (short name: NEWS;MGANBN) will help you find adverse or unfavorable information regarding a business entity.
Both Negative News sources leverage LexisNexis SmartIndexing Technology™ terms to simplify research for adverse news. These negative terms—hundreds of words and phrases selected and tested by the LexisNexis team of expert indexers—are based on the vocabulary that defines a particular topic. For example, phrases for Negative Business News include:
- business downturn
- company’s mismanagement
- corporate problems
- deceptive business practices
- deceptive sales practices
- stock fell
Negative Personal News looks for a large range of phrases such as:
- arraigned
- arrested
- facing charges
- a suspect in
- suspected of
- under arrest
- under investigation
If enough negative vocabulary is present in the document, it is tagged and included automatically in the appropriate negative news files.
The entire document does not need to be negative in order for it to be included. And even if a document contains positive discussion of a company or person, it will be tagged for Negative News resources if it also contains negative discussion.
The LexisNexis News & Business team, working in conjunction with the LexisNexis SmartIndexing Technology editors, will continue to add relevant terms to enhance negative news search results.
Search Tips
To add precision to your research in Negative News sources, consider adding:
- The COMPANY or PERSON segment to your search, e.g.:
SOURCE: Mega News, Negative Business News
*SEARCH: COMPANY(behemoth)
OR
SOURCE: Mega News, Negative Personal News
*SEARCH: PERSON(john doe)
- A relevancy score, e.g., articles at least 80% relevant to a specific person or business. For example:
SOURCE: Mega News, Negative Personal News
*SEARCH: PERSON(john doe PRE/2 8*% OR 9*%)
- The HLEAD (in the headline or lead paragraph) segment and the ATLEASTn operator to your person or company search.
For example:
SOURCE: Mega News, Negative Business News
*SEARCH: COMPANY (behemoth)OR HLEAD (behemoth) AND ATLEAST3 (behemoth)
Plus … Negative News searches may also be saved as LexisNexis® Alerts for automatic update on a regular basis—from monthly up to three times a day for breaking news.

LIBRARIAN TO LIBRARIAN...Fulfilling the Promise: A Progress Report on the LexisNexis® Total Practice Solutions Strategy
by Cindy Spohr, Senior Director, LexisNexis Librarian Relations Group
Last year at this time, I asked you to look forward as LexisNexis introduced Total Practice Solutions, an expanded enterprise vision that included integrated tools and resources to help your organization achieve excellence in the business of law as well as the practice of law.
You did—enthusiastically reviewing new products and tools and offering solid advice on how future enhancements could best meet your needs and goals as well as those of your patrons. And since the LexisNexis Librarian Relations Group’s mission is to present your interests and concerns to LexisNexis management as well as to provide you expert training and personalized support, the LexisNexis Librarian Relations team took your words to heart … and to the right ears.
This January I thought you deserved an update. Think of it as a touchstone on the progress of LexisNexis Total Practice Solutions as they evolve—new products, enhancements, acquisitions and alliances—based on customer feedback:
Research Solutions—exclusive sources vital to client success
A legal mainstay for LexisNexis subscribers, in 2006 LexisNexis cultivated Research Solutions on two different fronts.
First … functionality, i.e., getting to the right resources quickly and easily. In 2006, you and your patrons saw a variety of enhanced LexisNexis functionality, including the LexisNexis® Toolbar (a free download) that lets you move easily across lexis.com® and the Web; a redesigned News & Business tab that puts sources at your fingertips faster; extended access to research history—available for a full 24 hours; and enhanced searching that lets you combine up to 50 sources across menu screens.
Plus we provided you with more ways to track—and stayed updated—on important content. LexisNexis® Total Alerts powered by Ozmosys® gives information professionals the ability to personalize and distribute high-value content more effectively. (See story in this issue.) And now you have access to breaking news within five minutes of release with LexisNexis® Continuous Alerts powered by Factiva.
Second, content itself expanded. That’s nothing new. LexisNexis adds hundreds of new resources to your existing subscription every year. What made 2006 stand out were the types of new resources, such as:
- Historical quotes with coverage back to 1970.
- Litigation practice guides to key jurisdictions, including California, Florida and New York.
- 50 state insurance surveys focusing on claims, settlement issues, adjuster licensing, prompt-pay rules, and other key topics.
- Full-text blogs from Newstex Blogs on Demand—tailored, real-time news and commentary from thousands of branded newswires, newspapers, magazines, financial and business sources, etc.
- Negative Personal News and Negative Business News (See the story in this issue.)
- LexisNexis Global Legal Research—more than 1,000 international legal sources from Australia, Canada, Germany, New Zealand, and the United Kingdom (800 additional sources).
Litigation Services—strategic insights plus greater control throughout the litigation process
What a watershed year! In 2006, you saw one-point access to an unmatched portfolio of litigation resources and tools. LexisNexis Total Litigator is organized around litigation tasks—filing, drafting, discovery, legal research and investigation. LexisNexis Total Litigator is endorsed by the National Institute for Trial Advocacy as “the best option for litigators” and designated “the preferred online litigation tool for litigators” by the Defense Research Institute.
Litigators also saw electronic service of process with LexisNexis® File & Serve Service of Process.
And they could draft and review legal documents more quickly and accurately with Shepard’s® Brief Suite™ and Shepard’s® BriefCheck™ for the Web. The documents they created—and acquired during discovery—could be managed more effectively with tools such as Concordance™ evidence-management software, CaseMap® case-analysis software and TextMap® transcript-summary software.
Client Development—networking and marketing resources to grow the practice
During 2006, this growing solutions area saw enhancements to the Martindale-Hubbell® Peer Review Ratings™ system and worthwhile new information products specifically designed for client development, like the atVantage™ business-development tool that gives you unprecedented access to critical company and industry intelligence, comprehensive litigation and transaction data, even law firm and attorney information. And find in-depth corporate information with a Corporate Intelligence subscription to InterAction®, a new content subscription for InterAction that offers key company profile information directly into InterAction and linking to LexisNexis atVantage.
Practice Management—services and tools proven to improve firm productivity and profitability
With LexisNexis Practice Management Solutions, documents can be shared easily and securely with clients and co-counsel. And documents can be protected and backed up in redundant, world-class data centers to ensure business continuity. In 2006, LexisNexis also worked to help customers cut document-management costs by eliminating the hardware, system and client software, and ongoing administration of legacy client-server DMS with NetDocuments® from LexisNexis®, a Web-hosted Software-as-a-Service (SaaS).
2006 was an exciting year for LexisNexis as you can see. But we’re not content to rest on last year’s successes. 2007 promises to be equally exciting as we continue to fulfill the promise we made to you and your organization: to help you achieve excellence in the business and the practice of law.
As for the LexisNexis Librarian Relations Group, 2007 also holds wonderful things in store. We’ve got a great team of librarian professionals. We look forward to working with you, showing you the latest products and services that help you do your job more effectively, and taking your comments and suggestions to senior management and product developers.
I look forward to hearing from you about ways we can continue to build on this partnership that works!
KNOWLEDGE EXCHANGE . . .Whittle ‘Daily Update Overload’ into a Power-Packed E-Mail Using LexisNexis Total Alerts Powered by Ozmosys®
By Matt Wagner, LexisNexis Senior Librarian Relations Consultant
Remember when a paper routing slip served as primary delivery mechanism for distributing journals, periodicals and other current-awareness publications in law firms? Countless in our ranks attached those slips day after day, week after week. And the poor associates waited to get their hands on information involving newly promulgated regulations and recent opinions published in a popular legal periodical as it sat buried on the corner of a partner’s desk.
Today law librarians disseminate information electronically via e-mail and firm intranets, while feverishly trying not to exceed the “rules” parameters in the firm’s e-mail software and to avoid “Cut & Paste” overload. And that same associate who waited patiently to receive that hard-copy newsletter now has 10 or so e-mails every day to sort through in order to stay abreast of client developments and practice-area trends.
Not to worry … LexisNexis comes to the rescue for the librarian and the attorney with LexisNexis Total Alerts powered by Ozmosys, a solution that allows firms to simplify, consolidate and deliver critical information to anyone who needs it. With
LexisNexis Total Alerts, any individual in the firm can receive a single e-mail each day with updates from their essential information sources. What’s more, LexisNexis Total Alerts enables librarians to quickly and easily personalize and distribute information.
So how does it work? LexisNexis Total Alerts streamlines enterprise distribution list management and electronic content delivery. It allows you to consolidate electronic delivery of some LexisNexis subscriptions (LexisNexis® Publisher, Mealey’s™ and CourtLink), Web sites (government and commercial), blogs and RSS feeds as well as other premium content subscriptions (e.g., BNA®, CCH®, Westlaw® and many more).
LexisNexis Total Alerts also offers customized distribution of certain content to specific individuals or groups. It’s also flexible—allowing you to add or discontinue content updates as your needs change.
Here’s a review of some of the key features of LexisNexis Total Alerts powered by Ozmosys:
- Alpha Directory—Now this tool allows you to search for users and alerts in alphabetical order; simply use the A – Z directory.
- Distribution Lists—As the Total Alerts Administrator, you can create distribution lists with no limitations and assign customized information, e.g., topic groups and individual alerts, to members of the organization.
- E-mails—End users have the option of receiving two e-mails—morning and late afternoon. Or they can choose to receive e-mail only when there is new information. Update Now allows users to check for updates throughout the day.
- Prioritizing Alerts—Arrange the order of alerts in a user’s e-mail so they are ranked by importance or relevance rather than in alphabetical order.
- Reports—The reporting tool allows the LexisNexis Total Alerts administrator to monitor the number of users receiving specific alerts. You can also remove users from an alert.
- Topics—Group similar alerts for more efficient distribution. For example, there may be certain content that everyone in your Coporate/Securites practice receives. With the Topics feature, you can assign several subscriptions all at once to a single user rather than one at a time. (Combine the power of the Topics feature with the Distribution List to assign subscriptions to entire groups.)
- Time Zones—Choose when users receive their LexisNexis Total Alerts e-mail by selecting the applicable time zone … a particularly valuable tool for national and global organizations.
Not only do some features of LexisNexis Total Alerts provide you with enhanced delivery of information throughout the firm, they are easy to implement. LexisNexis Total Alerts powered by Ozmosys is a Web-based platform that requires no software downloads. (That means no waiting in line to get on your IT department’s “To-Do List.”)
As an added bonus, LexisNexis Total Alerts also ensures compliance with copyright and vendor agreements because it permits only the users you have designated to receive a particular subscription.
Librarians have always played a role in knowledge management in law firms. And as the legal marketplace grows more competitive, your role in delivering knowledge is more crucial than ever. Let LexisNexis Total Alerts guide your way!
But you don’t have to take my word for it. Get additional information on LexisNexis Total Alerts powered by Ozmosys at http://www.lexisnexis.com/totalalerts/ For a demonstration of LexisNexis Total Alerts and/or a 30-day trial without charge, just contact your LexisNexis Librarian Relations Consultant. See for yourself how you can deliver the right information to the right people at the right time.
