1)Complete More Tasks, Tap More Litigation Resources with New LexisNexis® Total Litigator
LexisNexis Total Litigator is the only litigation resource organized just the way litigators work today, i.e., by tasks that occur throughout the life of a case—from early case assessment to trial. And now, Total Litigator, endorsed by NITA® as the “best option for litigators” and named “the preferred online litigation tool for litigators” by the Defense Research Institute, offers more—more tasks, more resources mapped to those tasks, more functionality and even a brand-new look.
See for yourself; it’s easy to do. Now when you sign on to www.lexis.com, you can gain access to LexisNexis Total Litigator by just clicking the purple Total Litigator button at the top right of the main menu screen. No additional log-on is needed.
The first thing you’ll notice is several changes to the Total Litigator home page. New font sizes, images and tab titles make the home page even easier to browse. You’ll also see three new tabs. (See more details about each new tab inside this issue.) On the left side of the page, you’ll find quick access to Mealey’s™ new podcasts, giving you daily updates on major litigation, including filings, trials and settlements.
But some of the new enhancements have to be explored to be appreciated. One great example … LexisNexis® CaseMap® 7, the newest version of the award-winning, case-management software, is now integrated even more closely with Total Litigator. For instance, in order to get the full text of a case opinion (or its Shepard’s® report) logged in CaseMap, just click on the case citation and follow the drop-down menu. Similarly a CaseMap user can highlight a name (of a person, company, etc.) on the Objects page of CaseMap and then right-click to send that name to LexisNexis Total Litigator for information gathering. (Read more about new CaseMap 7 within this newsletter.)
The Total Litigator Preferences menu has new options to make litigators more efficient. IDs can be managed easily via that menu. You can also ensure that Total Litigator’s users are notified of menu items outside your LexisNexis subscription (e.g., via the $ symbol). Finally users can even select a default Practice Area (from more than 30). Then when they choose a Total Litigator tab that includes practice area designations, their default practice area will display automatically.
2) Take a Closer Look! New LexisNexis Total Litigator Resources and Functionality Help You Complete More Tasks
Whether a litigator needs to gather information, draft discovery requests, or even do basic legal research, LexisNexis Total Litigator makes the task easier. That’s because the databases, products and even services, such as service of process, available via LexisNexis® are matched to recognizable litigation tasks. And those tasks are grouped by easy-to-recognize tabs, such as Gather Intelligence, Discovery and Research. No more complex source selection. Just choose the task right from the top of the Total Litigator screen.
The latest version of LexisNexis Total Litigator has expanded to offer three new task tabs: Early Case Assessment, Trial Prep and Search by Source.
Early Case Assessment
This task tab will help litigators “jump-start” cases more quickly and with more confidence than ever before. Select from these tasks:
- Case Evaluation—Review verdict reports and demographics to help assess the value of a case and the characteristics of potential jurisdictions.
- Research Judges—Conduct a fast check or do a thorough review … it’s your choice. Select one, several or all of these resources:
- Judicial Staff Directory
- Mega News (which includes Factiva® resources)
- LexisNexis Analyzer (for a Judge), which includes searches through case opinions, law review articles, directories (including Martindale-Hubbell®), verdict reports and even news sources (including Mealey’s)
- CourtLink® Strategic Profiles that focus on judicial activity
- Initial Fact Investigation—Choose to research a litigant (individual or organization), attorney or expert. Then select from various resources, including news, public records and docket resources.
- Elements of Claim: Jury Instructions—Search federal or state jury instructions.
- Organize Case Facts—Get more details on the CaseMap case-analysis tool, which helps litigators organize and link information about the case’s key facts, documents, parties and legal issues. Not using CaseMap yet? Link right from Total Litigator to download a free trial version. (For more details on CaseMap, TimeMap® and NoteMap®, see the October 2006 LexisNexis Information Professional Update.)
- Create a Timeline Graphic—Link to more details on how litigators can use TimeMap to create visual timelines depicting and analyzing evidence uncovered during litigation.
- Outline Tools—Link to more details on how litigators can use NoteMap to create and edit outlines.
Trial Prep
This task tab ensures litigators don’t miss a thing when preparing for trial. Gain access to state and federal court rules as well as jury instructions. Profile witnesses (both lay and expert) as well as jurors. Choose among:
- Court Rules—Review court rules for federal courts or those for various states.
- Jury Instructions—Choose a jurisdiction or practice area.
- Pretrial Conference Tools—Review the LexisNexis collection of procedures, practice guides, form books and more.
- Evidence: Documentary or Evidence: Demonstrative or Evidentiary: Strategy & Limine Motions—Select a topic and then search relevant treatises, guides and forms.
- Jury Pool Demographics—Gain access to demographic reports to get a better sense of a jury.
- Witness & Juror Investigation—Select from various types of comprehensive reports, such as SmartLinx® and CourtLink Strategic Profiles, and individual sources, including public records, news, case law and more.
- Direct & Cross Examination—Find more than 60 practice guides, manuals, form books and more to aid you.
- Jury Selection Tools—Select a jurisdiction and all available materials are ready to be searched.
- Opening & Closing Statements—Appropriate resources are automatically gathered for your review.
- Witness Preparation—Link to details on gaining access to the DepoPrep® tutorial that help clients prepare for depositions.
- Transcript Management Tools—Link to details for acquiring the TextMap® product. TextMap offers electronic transcript files, complete with searching capability and vital synchronization features. (See October 2006 Update for more TextMap information.)
- Case Analysis Tools—Link to information about CaseMap 7 software.
- Timeline Presentation—Link to information about TimeMap software.
Search by Source
This task tab will help you identify and search individual sources quickly—both from the same screen. Or browse suggested sources for getting certain types of information. Here’s how:
- Find a Source—Enter a source name (or partial name, e.g., moore’s) and click FIND. Then just select your source from the results list, enter your search terms (using terms & connectors or via Easy Search™) and click SEARCH. Sources are pulled from www.lexis.com, so if you cannot find a source through the task tabs, you can still gain access to it without leaving LexisNexis Total Litigator.
- Suggested Sources—Enter your search terms (e.g., a person or company name), select the “entity” you are researching (e.g., company), and click SEARCH. That’s it. You’ll get a complete list of resources you should consider searching. Then just click on the source name to initiate a search. It’s a fast, simple way to pull together vast quantities of information on various litigation players.
More Research Coverage
LexisNexis Total Litigator now offers 100% jurisdictional coverage as
well as Practice Area Views. For example, select “Case Law, Briefs &
Motions” under the Research task tab and find federal and state coverage,
including resources for the District of Columbia, Guam, Northern Mariana
Islands, Puerto Rico and the Virgin Islands.
Also find one-click access to Lexis® Search Advisor, available
from the left side of the Research task tab.
ONLINE WITH . . .“Integration” is Key to New CaseMap® 7 Enhancements
New CaseMap 7 is ready for download at www.casesoft.com And now, the newest version brings tighter integration with the latest versions of LexisNexis Total Litigator and LexisNexis® CourtLink®:
New CaseMap 7 and LexisNexis Total Litigator Integration Features:
Select any term in your CaseMap case-analysis spreadsheets and send it to LexisNexis Total Litigator for research. Plus, you can select and right-click a citation in a CaseMap Research-Authorities spreadsheet, and the shortcut menu lets you find the citation in LexisNexis Total Litigator. Shepardize® it and/or retrieve and print a full-text copy of the case with only two mouse clicks.
Plus the main CaseMap 7 toolbar on the left side of the screen now includes a new LexisNexis bar at the bottom. Find convenient links to both Litigation Tasks and Litigation Tools. The same choices are available from the Total Litigator button on the right end of the standard toolbar. Click the bar or the toolbar button to link to tasks like Early Case Assessment or Discovery and Research.
New CaseMap 7 and LexisNexis CourtLink Integration Features:
CourtLink proceedings can be sent directly to CaseMap 7; just right-click on a docket. (You can highlight a proceeding in a docket, select a checkbox for a proceeding or right-click anywhere in a docket.)
In the latest version of TimeMap, send dates and text from a selected set of proceedings to a project in TimeMap, displaying them chronologically as Facts. Send to TimeMap buttons appear in dockets for courts in: U.S. District Civil, Criminal, Bankruptcy, the Circuit Courts of Appeals, and Delaware Chancery. (Note: TimeMap 4.1 is available for download at www.casesoft.com and you must have the latest version to utilize the new CourtLink integration features.)
Enhanced CaseMap Acrobat® Plug-In PLUS:
CaseMap PDF Bates Stamper arrived with CaseMap 6. Now CaseMap 7 gives you enhanced tools to help you:
- find specific Bates-numbered pages,
- filter to limit your spreadsheet view to a range of documents,
- analyze your document index to identify potential problems in your Bates Number entries,
- synchronize Bates End/Pages fields, and more.
Plus enhancements to Acrobat® 8 are completely compatible with CaseMap 7. (New CaseMap Acrobat PLUS Plug-in enables CaseMap 7 to recognize Acrobat 8 Bates Stamps and import them into CaseMap just like our own PDF Bates Stamper.)
Bulk Send to CaseMap Feature:
The new CaseMap 7 infrastructure allows other programs that offer the Send to CaseMap feature to enable a Bulk Send to CaseMap. And the new Bulk Send to CaseMap wizard will allow you to define which fields and data are transferred.
KNOWLEDGE EXCHANGE . . . Global Legal Resource Offers Features to Take You “Around the World” in 1,000 Sources

Now boarding … LexisNexis flight 2007 with stops in Australia, Canada, Germany, New Zealand and the United Kingdom!
Global legal research can be some of the most challenging research you will ever encounter. Trying to get native documents from a source across an ocean—or two—can be frustrating, especially when you add in the time differences. But now you have a reliable source for legal materials, available at your fingertips whenever you need it: LexisNexis® Global Legal Sources.
Gain access to these materials from a number of places on lexis.com®: the main Legal tab, the International Law menu and the International Trade menu. (Just select those areas of law from Areas of Law – By Topic.)
The new Global Legal Sources includes more than 1,000 resources from Australia, New Zealand, Germany, Canada and the United Kingdom. More than 800 of these sources are new to the LexisNexis services—and not available otherwise on lexis.com. This collection of sources is presented through an integrated global platform, allowing you access to all of these materials without visiting multiple sites. And this new platform uses the same search engine as lexis.com, so you get the same pinpointed results you expect from lexis.com.
Source selection in the Global Legal Sources varies from lexis.com. There are several ways to approach source selection:
- choose from the drop-down list of commonly used sources;
- browse sources by type and/or by topic; or
- find sources by searching with keywords.
Once you have identified the relevant sources for your research, you can create your own combined sources. Simply check the boxes to the left of the source titles. See Selected at the right of the screen above the source list to keep track of selected sources. Need to review your selections? Just click View. When you finish selecting sources, click OK and return to the search screen.
LexisNexis Global Legal Sources also include some unique features to help you manage your research results efficiently. For example:
- View results by type, publication or language and sorted by relevance or by date.
- Narrow search results by using the Narrow Search box, a feature we know as FOCUS™.
- Tag documents for easy identification or delivery. View tagged documents in a consolidated list by clicking View Tagged. To return to the complete results list, just click View All Results.
Plus, the LexisNexis Global Legal Sources History tab includes a search history, a document history and a Saved Searches section. The Recent Documents section of the History tab keeps a list of all documents that have been viewed in full text. The documents are available for 28 hours. The Saved Searches section allows you to construct and keep up to 100 searches for your research convenience.

1)Add Shepard’s Signal™ Indicators to Delivered Documents (and Request Full-Text Shepard’s® Report)
Now when you print the full text of a case (or case-search cite list) that includes Shepard’s editorial treatment, you can add the Shepard’s Signal™ indicators to your delivered print, e-mail, fax or downloaded copy. And when you request a print copy of the case, you can include the full text of the case’s Shepard’s report.
For example, your case-law research results include Ohio Casualty vs. Union Pacific Railroad, 469 F.3d 1158 (2006). When you select the Print link, note the print selection screen. The Include Shepard’s Signal box is checked automatically, the default setting.
The Shepard’s Signal indicator will be delivered with an “as of” date stamp to remind you of the delivery date—and to remind you that signals can and do change over time.
Wherever possible the Shepard’s Signal indicator will print as a graphic. In situations where the signal cannot print, a textual signal, e.g., Questioned By, will be included.
Though not a default setting, you can request a case’s corresponding Shepard’s report along with the full-text document delivery. Just check the Print Shepard’s report for current document box on the document selection screen.

3) WSJ.com Law Blog Breaks News, Reports Responses Immediately
If you’re interested in emerging legal issues, don’t miss The Wall Street Journal Online Law Blog.
The Law Blog is the marquee feature of The Wall Street Journal Online’s Law Page. (Select the Law page from the main WSJ.com news menu.) Blogger Peter Lattman sifts, summarizes, analyzes and reports the news lawyers need—starting before dawn. By the time you log on, the morning’s news is filtered and ready. And posts are updated throughout the day.
Within the last several months, WSJ.com Law Blog readers got insights into:
- Stock Options back dating, because Lattman provides continuous updates on the companies and executives accused, and the legal issues they face.
- Vioxx®, because the Law Blog surfaced exclusive details on jurors’ takes on the trials, a regularly updated “scoreboard” on the company’s win/loss record and more.
- Enron—right from the Houston courtroom, bloggers sent dispatches analyzing the smart legal moves—and missteps—of the prosecution and defense alike.
