The plaintiffs' motion for summary judgment was granted after plaintiffs challenged a regulation jointly issued by the Army Corps of Engineers and the Environmental Protection Agency that governed when the use of "mechanized earth-moving equipment" resulted in the discharge of "dredged or fill material" and was thus subject to a permitting regime administered by the Corps.
