Insurer's Conclusion That Autism Therapy Is Experimental Is Arbitrary, Judge Rules

DETROIT - A health insurer arbitrarily and capriciously denied coverage for applied behavioral analysis (ABA) therapy for autism based on the plan's exclusion for experimental treatment under the Employee Retirement Income Security Act, a federal judge in Michigan ruled March 30 (Michael Potter v. Blue Cross Blue Shield of Michigan, No. 10-14981, E.D. Mich.; See 8/3/11, Page 9).
